  1. Goal 6.03 Unit 4: Identify the various procedures in the enactment , implementation, and enforcement of law. The American Legal System. Chapter 15, Section 3 I: Protections in the US Constitution. A: Individual Rights: 1. Writ of habeas corpus: requires an official who has arrested someone to bring that person to court and explain the charges against them.

  2. I: Protections- Individual rights • 2. Article I forbids enactment of bills of attainder ( a law that punishes someone accused of a crime without a trial or fair hearing in court). And ex post facto ( a law that would allow a person to be punished for an action that was not against the law when it was committed).

  3. B: A Guarantee of rights • 1. Due process of law: (5th and 14th Amendments)means, in part, that gov’ts cannot take our lives, liberty, or property except according to the proper exercise of law. (This was to insure that the govt. would not be able to abuse its power) • 2. Equal Protection Clause: (14th Amendment) means everyone is treated equally .

  4. II: Civil Lawsuits-Chapter 16, Sec. 1 Why do people file civil suits? A: People who bring of file suits claim to have suffered a loss or injury. They are the plaintiff. They seek damages ($) from the defendant (the party being sued) B: misdemeanors: less serious crimes- vandalism. C: Penalties for crimes 1. serve several functions • provide punishment • protect society • serve as a warning to others

  5. Turn to page 450 and read the section • Step 2. Complete the graphic organizer on page 450. • Define the vocabulary words in your notes • summons • complaint • discovery • settlement • What is mediation and arbitration? Define and explain. • At trial what is the difference between civil and criminal with regards to how the trial is tried?

  6. Stop! • Make sure you know the difference between settlement, arbitration, mediation. • Work on your study guide vocabulary list. • You should have a good understanding of how a civil and criminal case proceeds through the court.
