Definitions: 3101 • Complainant - alleged victim of a crime • Deviate sexual intercourse - per os / per anus; human or animal; foreign object, any purpose other than legiti-mate medical use
Definitions • Forcible compulsion - physical, psychological, moral, emotional; express / implied; before, during, or after intercourse • Foreign object - not part of human body
Definitions • Indecent contact - touching sexual or intimate body parts for gratification or arousal (actor touching or being touched) • Serious bodily injury – see chapter #23 • Sexual intercourse - per os / per anus, slight penetration, emission not required
Mistake as to Age: 3102 • Criminality age under 14 • Prove over 14 preponderance of evidence used
Evidence of victim’s sexual conduct: 3104 • Can’t introduce the following unless with defendant &filed in writing with the court prior to trial
Evidence of victim’s sexual contact • 1. Past sexual conduct • 2. Opinion evidence of past sexual conduct • 3. Reputation evidence of past sexual conduct
Prompt complaint: 3105 • Not required for prosecution • Loss of evidence
