  12. Tribal Open Dumps Background • Public Law 103-399, Indian Lands Open Dump Cleanup Act of 1994 • Enacted October 22, 1994 • Congressional concerns on solid waste open dump sites located on Indian lands

  13. Tribal Open Dumps Background • Purposes of Act • Locate open dumps on Indian lands • Assess the relative health and environmental hazards • Provide financial and technical assistance to close open dumps to comply with Federal and/or Tribal standards

  14. Tribal Open Dumps Background • Indian Health Service (IHS) assigned to conduct inventory of all open dumps on Indian lands • Submit annual report to Congress • IHS to also identify level of funding needed to bring dumps into compliance and develop solid waste management plans

  15. Tribal Open Dumps Background • Act requires IHS to consult with EPA, tribes, state and other federal entities

  16. Tribal Open Dumps Status Today • 2006-2011 EPA Strategic Plan • By 2011, close 138 open dumps on Indian land compared to FY 2006 • By 2011, increase by 118 the number of tribes covered by ISWMP compared to FY 2006
