CA Standards • 8.2.3Evaluate the major debates that occurred during the development of the Constitution and their ultimate resolutions in such areas as shared power among institutions, divided state-federal power, slavery, the rights of individuals and states (later addressed by the addition of the Bill of Rights), and the status of American Indian nations under the commerce clause. • 8.2.6 Enumerate the powers of government set forth in the Constitution and the fundamental liberties ensured by the Bill of Rights.

  3. DGQ’s • What do Amendments 1-3 protect? • Amendments 4-8 protect who? • Amendments 9 and 10 deal with what?

  4. Amendment • The only way the Constitution can be changed. • First ten amendments are called the Bill of Rights. -ratified 1791.

  5. #1 Freedom of Expression • Religion -No Harm, illegal acts. • Assembly -Time, Place, and # of people. -Permits needed. • Press -Libel (written, lying, cause harm). -National Security.

  6. Petition -Format. • Speech -Clear and Probable Danger (incite violence or illegal acts). -Slander (lying/ cause harm). -Obscenity (vs. Indecent). • Remember R.A.P.P.S.

  11. #5 Rights of the Accused • Can’t Self Incriminate • Double Jeopardy • Due Process • Like the movies, “I plead the5th”

  12. #6 Right to a Speedy Trial • Have a jury of peers • Confront witnesses/ accusers • Have a lawyer defend you • Remember 0 to 60 in 6seconds, that’s fast

  13. #7 Jury Trial in Civil Cases • Remember this SEVEN CIVIL

  14. #8 Bail and Punishment • No excessive Bail • No cruel or unusual punishment • Remember that the 8 looks like a pair of handcuffs

  16. #9 Power Reserved to the People • Enumerated powers. • If it is not in the Constitution, don’t worry it doesn‘t mean you can’t have it. • Remember that a 9 is a backwards P for Power of the People

  17. #10 Powers Reserved to the States • If it is not written in the Constitution, it’s up to the states • Remember, “If the Constitution did not Attend to it, it’s up to the states”
