On October 12, 2011, the Office of Juvenile Affairs’ Rates and Standards Committee recommended the creation of a Level D MR rate and standard to better serve developmentally challenged populations. Following approval by John Morrison on October 27, 2011, the proposal addresses concerns from service providers regarding the ineffectiveness of current counseling requirements for MR clients. The new rate maintains the daily charge of $86.15 while eliminating mandatory counseling, allowing for increased direct care staffing to meet the needs of this specific juvenile population.

RATES AND STANDARDS Board of Juvenile Affairs December 2, 2011
On October 12, 2011, the Office of Juvenile Affairs’ Rates and Standards Committee voted unanimously to recommend the creation of a Level D MR rate and standard. As required by statute, DCS was given notice of this rates and standards proposal on October 12, 2011. On October 27, 2011, John Morrison of the Department of Central Services approved the rate proposal.
Overview Service providers have given notice to OJA that group and individual counseling requirements of a normal level D program are ineffective for MR populations. OJA is proposing that a new Level D MR rate be created to better accommodate this particular population.
Legal Authority • 10A O.S. §2-7-305(B)(1) authorizes OJA to implement community-based residential care for juveniles, who are in the lawful custody of OJA and deemed by OJA to be in need of such services.
Budget Impact • The budget impact is the loss of RBMS which is estimated to be $55,000 per year. This revenue decrease has been offset through savings generated by recent reductions in staff.
Justification OJA currently has one contracted 12 bed Level D program with developmentally challenged clients. This population requires a more intense direct care staff involvement. Housing units are limited to four beds each. These small units require a higher labor cost than a normal Level D program.
Summary • The Level D MR rate and standard is identical to the current Level D program except that the requirement for counseling, both individual and group, has been eliminated. The counseling funding has been moved to direct care staff – see attachment A. The rate per day will remain at $86.15. • OJA Staff with DCS’ approval is requesting that the Board of Juvenile Affairs approve this new Level D MR rate and standard.
