  5. Importance • Established the Supreme Court power of JUDICIAL REVIEW

  6. The Case • The state of Maryland put a tax on the Bank of the U.S., a federal institution

  7. The Questions • Is the Bank of the U.S. constitutional? • Can a state tax a federal agency?

  8. The Decision • Yes, using the elastic clause • No, because of Supremacy Clause

  9. Importance • Increased the power of the federal government over the states.

  10. The Case • Gibbons & Ogden both had ferry services from NY to NJ

  11. The Question • Can states regulate interstate commerce?

  12. The Decision • Interstate means movement BETWEEN 2 states

  13. Importance • Established that the Federal government has complete control over interstate commerce.
