Innovation Investment Package • Adopted by the Commission on 10 July 2013 • Total investment: €22 billion • ~€8 billion from Horizon 2020 • ~€10 billion from industry • ~€4 billion from Member States • 10 legislative proposals • 4 proposals for Public Public Partnerships (Joint programmes with Member States under TFEU Article 185): • European and Developing Countries Clinical Trials Partnership 2 (EDCTP 2) • Active and Assisted Living R&D Programme (AAL 2) • Eurostars 2 (for SMEs) • European Metrology Research Programme (EMPIR) • 5 proposals for Public Private Partnerships (Joint Technology Initiatives under TFEU Article 187) • Extension of SESAR (Joint Undertaking on Single European Sky ATM research under TFEU Article 187)

Legal basis for Article 185 TFEU Article 185 TFEU (ex Article 169 TEC): “In implementing the multiannual framework programme, the Union may make provision, in agreement with the Member States concerned, for participation in research and development programmes undertaken by several Member States, including participation in the structures created for the execution of those programmes”  Participating Member States are the driving force  Co-Decision (Ordinary legislative procedure in Parliament and Council)

  4. Article 185 Initiatives Three levels of integration are conditions for success • 1. Scientific integration: Common definition and implementation of research activities • central organization of calls • common evaluation and selection rules • centralized monitoring of projects • 2. Management integration: Dedicated Implementation Structure (DIS) with appropriate governance • 3. Financial integration • Ex-ante financial commitment by participating states • Agreement on central selection procedure and respect of the ranking list

Article 185 TFEU in Horizon 2020 (Art.20 of final compromise texts as endorsed by COREPER) (…) In addition, proposals (…) shall be identified on the basis of all of the following criteria: (a) a clear definition of the objective to be pursued and its relevance to the objectives of Horizon 2020 and broader Union policy objectives; (b) indicative financial commitments of the participating countries, in cash or in kind (…); (c) the added value of action at Union level; (d) the critical mass, with regard to the size and the number of programmes involved, the similarity or complementarities of activities and the share of relevant research they cover; (e) the efficiency of Article 185 TFEU as the most appropriate means for achieving the objectives.

Article 185 Implementation under Horizon 2020 Horizon 2020 spells out integration levels for using the Article 185 instrument • Under FP7 this was not explicit Alignment required with objectives of Horizon 2020 • Under FP7 contribution to societal challenges was not a criterion for Article 185 Initiatives Rules for participation and dissemination of Horizon 2020 will apply to Article 185 initiatives • Under FP7 Article 185 Initiatives were not covered by the Rules for Participation

Possible JPI Support under Article 185 Key Criterion Member States Must Commit to Integration of their Research Programmes in an Area Corresponding to a Horizon 2020 Priority • Firm commitment to scientific, management and financial integration • Demonstrated capacity for significant collaboration and added value • Clear evidence of necessary scale and scope in line with Horizon 2020 • Confirmed financial commitments of participating countries • Article 185 proven to be most appropriate means of achieving objective
