  1. Jesus: Explaining Law? Or, Teaching His Own “New” Law • Matthew 5: • Verses 17-19 “Whoever breaks one of the least…” • Verse 20 “righteousness must exceed the righteousness of the scribes & Pharisees” • Vs. 27 Was “lust” acceptable under the Law? • Vs. 33-37 Are “oaths” wrong under the New, but right under the Old? • Vs. 38-42 Was “eye for an eye” right under the Law, but now wrong under the New? • Vs. 43 Was it right to hate your enemy?

  2. Jesus: Explaining Law? Or, Teaching His Own “New” Law • Matthew 5:31-32 • Is Jesus quoting the Law or Pharisaical tradition? • Is Jesus correcting Pharisaical interpretation of Deut. 24 or giving a new law in opposition to Deut. 24? • If the latter, He would be accused of teaching contrary to the Law which is what He denied (5:17-18). • Did Jesus ever teach contrary to the Law?

  3. Jesus: Explaining Law? Or, Teaching His Own “New” Law • Matthew 19: • Vs. 3 “Is it lawful…” What “law” are Jesus & the Pharisees talking about? What “law” does Jesus quote? • Jesus claims the “law” is Gen. 2:24 & therefore “it is not lawful(under the Law) to divorce for any cause.” • Jesus denied that what Moses wrote was the answer to the question: “Is it lawful to divorce for any reason?” Deut. 24 is not the “Law.”

  4. “Contingency” Legislation Does Not Condone the Action • “If a man strikes the eye of his servant, and destroys it, he shall let him go free for the sake of his eye” (Ex. 21:26) • If a man beats his servant with a rod, so that he dies under his hand, he shall surely be punished. Notwithstanding, if he remains alive a day or two, he shall not be purnished; for he is his property” (Ex. 21:21)

  5. “Contingency” Legislation Does Not Condone the Action • “Ifa man strikes the eye of his servant, and destroys it, he shall let him go free for the sake of his eye” (Ex. 21:26) • If a man beats his servant with a rod, so that he dies under his hand, he shall surely be punished. Notwithstanding, if he remains alive a day or two, he shall not be purnished; for he is his property” (Ex. 21:21)

  6. “Contingency” Legislation Does Not Condone the Action • “If a man finds a young woman who is a virgin, who is not betrothed, and he seizes her and lies with her, and they are found out, then the man who lay with her shall give to the young woman’s father fifty shekels of silver, and she shall be his wife because he has humbled her; he shall not be permitted to divorce her all his days” (De. 22:28-29)

  8. “Contingency” Legislation Does Not Condone the Action • 1"When a man takes a wife and marries her, and it happens that she finds no favor in his eyes because he has found some uncleanness in her, and he writes her a certificate of divorce, puts it in her hand, and sends her out of his house, 2 "when she has departed from his house, and goes and becomes another man’s wife, 3 "if the latter husband detests her and writes her a certificate of divorce, puts it in her hand, and sends her out of his house, or if the latter husband dies who took her as his wife, 4 "then her former husband who divorced her must not take her back to be his wife after she has been defiled; for that is an abomination before the LORD, and you shall not bring sin on the land which the LORD your God is giving you as an inheritance.

  12. “Contingency” Legislation Does Not Condone the Action • Suppose a man enters into marriage with a woman, but she does not please him because he finds something objectionable about her, and so he writes her a certificate of divorce, puts it in her hand, and sends her out of his house; she then leaves his house and goes off to become another man’s wife. 3 Then suppose the second man dislikes her, writes her a bill of divorce, puts it in her hand, and sends her out of his house (or the second man who married her dies); 4 her first husband, who sent her away, is not permitted to take her again to be his wife after she has been defiled; for that would be abhorrent to the LORD, and you shall not bring guilt on the land that the LORD your God is giving you as a possession.

  13. “Contingency” Legislation Does Not Condone the Action • Is there anything in Deut. 24 that gives a man permission to divorce his wife? • Is there anything in Deut. 24 that gives a woman permission to remarry after being divorced? • The Pharisees believed Deut. 24 allowed them to scripturally divorce their wives for any reason. That’s what many teach today. • Jesus corrected that view in Mt. 5:32; 19:8,9

  14. “Moses Permitted” • Permit: “to permit, allow, give leave” • What did Moses “permit” or “allow?” • Divorce your wives for any reason • Was it “lawful” to do so? • Gen. 2:24 – No, it was not “lawful” • Then why did Moses write it? • “Because of the hardness of your hearts, he permitted…” • “But fromthe beginning, it was not so.”

  15. “Moses Permitted” • What about: “from Moses to Christ it was lawful to divorce for any reason?” • Then why: • Did God say He “hated” divorce; it was doing “violence,” & “He does not regard the offering?” Mal. 2:13-16 • Did Jesus say the Law was Gen. 2:24 & on that basis “unlawful?” Mt. 19:4-6 • Did Jesus say, divorcing her “causes her to commit adultery?” Mt. 5:32
