  2. Ethical Concerns • Competence & Training • Ineffective career counseling: • Test & tell (& point) • Counselors should not practice beyond their limits of competence, which comes from: • Training • Supervised experience

  3. Legislation • Title law - title is legally protected • Practice law - regardless of title, if you perform a service, you must work within the limits of your training and supervised experience and be appropriately credentialed

  4. Credentialing • Designed to protect the public from incompetent practitioners • Nationally Certified Counselor (NCC) • Training • Supervised experience • Exam (NCE)

  5. Credentialing • NCE has 8 basic content areas • Study guide available through NBCC • NCE is counselor license exam for 29 states (each state sets its own passing score)

  6. Credentialing • National certification - by organizations • Licensure - by state • Registration - similar to licensure in some states • License is a must, certification provides geographic mobility

  7. Credentialing • Purpose is to protect the public as opposed to a union designed to protect the workers • Not all certification organizations are credible • Public is generally unaware of credentialing • Good credentialing organizations will have continuing education requirements and an exam

  8. Ethical Concerns • Conflicts of interest • Third-party conflicts • Who is the client? • National Defense Education Act • Value conflicts • client wants to enter military against counselor’s judgment • Confidentiality

  9. Ethical Concerns • Remedy ethical problems with: • Awareness • Informed consent • Without informed consent: • Clients may have unrealistic expectations • If you get sued, you lose (even if you win)
