Organizational responsibility • Functional performers of HR management • at the MoD and SAF: • Human Resources Sector of the MoD and • Human Resources Department of the SAF General Staff (J-1). • Career leading at the SAF performed at 3 levels: • Human Resources Management Commission on operative level, • Human Resources Management Commission on level of General Staff and • Human Resources Management Council on level of Ministry of Defence. • The conductdesigned to provide transparency and multi-level decision making, • contributing contest against corruption.

The legal basis • Human resources management regulated at MoD and SAF: • the Law on Defense and • the Law on the Serbian Armed Forces; • General principles defined for: • admission to service, • ban of discrimination, • promotion and appointment to posts; • Two regulations further elaborate those principles: • Regulation on States in Service of Professional Military Personnel and Promotion of Professional Officers and NCOs and • Regulation on Admission to Professional Military Service. • The Criminal Lawgenerally applied for cases of corruption.

Criteria established • Criteria established for 3 sensitive area: • forming list of candidates for appointment to posts of higher rank; • selection of candidates for education and training and • promotion to a higher rank. • Positive influence recorded. • New model of professional selection (since 2011), • significantly reduced possibilities of individual protection and corruption; • Code of Honor of the SAF personnel(adopted in 2010); • Keeps, fosters and develops most valuable Serbian military traditions, • also follows general ethic principles.

The Criminal Law sanctioning corruption in defence • The Criminal Law regulates criminal acts against duties in service, related to corruption • The defined criminal acts: • influence trade, • taking bribe and • giving bribe. • Personnel of the SAF may be taken to responsibility in front of independent state authorities – civil courts • same procedure which exists for other citizens of Serbia; • decision on two levels; • possibility to engage attorneys are provided during the court process.

The Law on the SAF banning corruptive behaviour • Defines violations of military discipline which influence suppression of corruptive behavior at the army (directly or indirectly): • misuse of rights achieved through service; • illegal utilization of resources; • misuse of official duty; • reception of gifts related to performance of tasks out of legal framework; • taking services or achieving benefits for individual himself/herself or other related persons; • misuse of service in order to achieve influence which would provide individual to achieve rights related to a serviceman/woman of SAF; • non-application of interests which a serviceman/woman might have in relation to a decision of a state organ.

Serbia and the NATO BI Initiative • MoD joined the NATO BI Initiative in December 2011; • Self Assessment process done in 2012; • Efficient cooperation achieved with NATO experts; • Willingness to develop similar model of cooperation with the Transparency International and other organizations; • Mutual agreement on the final version of the Peer Review Report • The Report published at the web-site of the MoD: • http://www.mod.gov.rs/sadrzaj.php?id_sadrzaja=4353

Cooperation with the NATO Peer Review Team • 3 visits to the MoD and other state institutions • (between June 24th and November 2nd 2012). • 21 appointment at organizational units of the MOD and SAF • NATO experts spoke with representatives of 23 organizational units, two State Secretaries and three Assistant-Ministers. • 8 appointments at state institutions out of MoD • two committees of the National Assembly (Parliament), • The Ombudsman, • the Commissioner for Public Importance Information and Personal Data Protection, • Government’s Council for Contest Against Corruption, • Ministry of Foreign Affairs and • the governmental Anticorruption Agency (2x).

The outcome • Positive evaluation by Ambassador Dirk Brengelmann, NATO's Assistant Secretary General for Political Affairs and Security Policy • Expressed in a letter dated December 10th2012: • “Serbia’s commitment to good practice sends a strong message to other nations of the South Eastern Defense Ministerial (SEDM) Process to enhance transparency, accountability and integrity in the defence and security sector”.

  17. MoD of Serbia is ready to • At the National level: • Continue activities on building integrity at the MoD and SAF; • Continue work on the Serbian Government’s plan for building integrity and establishing responsible government. • In cooperation with NATO: • Coordinate activities with the NATO BI initiative; • Keep on participating at the Tailored BI Programme for South Eastern Europe. • On Multilateral level: • Expand cooperation with international organizations • (UN, OSCE and others). • On bilateral level: • Continue bilateral activities with states-partners • - (Norway and others); • Share experience with others who may be interested; • Keep on end expand cooperation with civil sector • - Transparency International, Global Impact etc.
