  6. The Federal Courts Supreme Court (Washington DC) Court of Appeals (San Francisco) District Court (Seattle and Tacoma) We are in the 9th Circuit Bankruptcy Court (Seattle and Tacoma)

  7. Supreme Court • Only hears Constitutional matters • 9 Justices • Chief Justice is John Roberts • Lifetime appointments • Checks and Balances • Justices must be confirmed by the Senate

  8. Supreme Court Examples • 1803 Marbury v. Madison- the power of the courts(putting other branches under judicial review furthering the checks and balances, first time something was said to be unconstitutional) • 1819 McCulloch v. Maryland- "the letter and the spirit“ (state action cannot impede constitutional exercises of the federal government) • 1896 Plessy v. Ferguson- paved the way for Jim Crow laws • 1954 Brown v. Board of Education of Topeka- separate is unequal • 1973 Roe v. Wade- legalized abortion

  9. Court of Appeals • 12 regional circuits • Hears appeals from the district courts located within its circuit and appeals from decisions of federal administrative agencies.

  10. District Court • Trial courts of the federal court system • Have jurisdiction to hear nearly all categories of federal cases, including both civil and criminal matters • Jury duty • 94 federal judicial districts • Western Washington District

Federal vs. State Courts • Established by Congress • Appeal directly to US Court of Appeals • May ask Supreme Court to hear- no obligation • Judges for life • Hears cases about: constitutionality, US laws or treaties, disputes between states, ambassadors and public ministers, admiralty, bankruptcy • Established by States • Appeals to intermediate courts • May ask highest state court to hear appeal • Judges either voted or appointed • Hears cases about: criminal, probate (estates), contract, tort, family law, state laws and constitutions

  12. Who hears it?Supreme Court, Court of Appeals, District Court, or State Courts • Mr. Bonner was caught spray painting mythical creatures on the walls of Glacier Peak. He is being charged with vandalism. • Mr. Blair was found guilty of saying slanderous things about Mr. Parker, but disagrees with the court’s decision due to his 1st amendment rights. • Oregon wants to sue Washington for dumping pollution in the Colombia River. • Mrs. Furlan thinks Mrs. Torre is in violation of her teaching contract because she dumped a garbage can over a student’s head who refused to recycle. • After a disappointing verdict in the Federal Court of Appeals, Mrs. Olson has asked this court to hear her case about owning a bazooka without a permit. • Mr. Hill will be charged in this court for illegally fishing in international waters.
