  2. Emancipation • Children are given freedom from the legal control and custody of their parents. • 18 years old, marriage, join the military • Children may petition the court (16)

  3. Family Responsibility Laws • Laws that require adult children to care for elderly parents. • Class 1 Misdemeanor

  4. Education • School attendance is required for children ages 7-16. • Truancy: Failure to attend school. • Parents may be fined or arrested.

  5. Compulsory Attendance Law • 3 absences: Notification of parent • 6 absences: Parent must be mailed a notification. • 10 absences: The D.A. is notified unless parents can prove they were not notified or made a “good faith effort”.

  6. Parental Responsibility for Children’s Acts • Persons, Children or Minors in need of supervision • “Undisciplined Youth” • Disobedient beyond parents control, found in unlawful places, runs away, excessive absences (age 6-16)

  7. Medical Care • Parents have the duty to protect and supervise their children’s health • Includes Medical and Dental Health • Obesity?

  8. Contributing to the Delinquency of a Minor • Parents are held responsible for acts of their minor children. • Underage drinking? • Any person who is at least 16 years old who knowingly or willfully causes, encourages, or aids any juvenile within the jurisdiction of the court to be in a place or condition, or to commit an act whereby the juvenile could be adjudicated delinquent, undisciplined, abused, or neglected as defined by G.S. 7B‑101 and G.S. 7B‑1501 shall be guilty of a Class 1 misdemeanor.

  9. Physical Abuse • Inflicts physical injury • Creates a Substantial Risk • Inappropriate means to modify behavior

  10. Sexual Abuse • Rape • Incest (family member) • Taking obscene photography of the juvenile • Sexual Exploitation • Taking indecent liberties (allows broader charges) • Sexual acts by a guardian

  11. Emotional Abuse • Pattern of behavior that impairs a child’s emotional behavior or self worth. • Causes anxiety, depression, withdrawal or aggressive behavior

  12. Child Witness to Domestic Abuse • A minor was in the position to observe the assault. • Placed under supervised probation

  13. Neglect • The Child: • Does not receive proper supervision • Not provided with medical or remedial care • Injurious environment (with not assistance)

  14. Termination of Parental Rights • A court decision ending the parental rights of an unfit parent. • Very long legal process

  15. Child abuse Prevention & Treatment Act • By law, government & medical officials must report a suspected case of Child Abuse • Statistics

  16. Parental Kidnapping & Prevention Act • Prevents Parents who abduct their children from getting new custody orders in a different state. • Missing Children
