  2. EVOLUTION ADB’s - Strategy 2020 : Recognized environment as a core operational area, and good governance and capacity development as drivers of change. The Asian Judges Symposium, Manila, 2010 : Largest congregation of judges since Global Judges Symposium on Sustainable Development and the Role of Law, South Africa, 2002

At the Symposium • international environmental law principles from the Stockholm and Rio Declarations were discussed, including: • precautionary principle (Indonesia) • intergenerational equity and the writ of continuing mandamus (Philippines) • public trust doctrine (Sri Lanka). • Judges discussed environmental specialization within the judiciary: environmental benches and certification of environmental expertise.

  4. At the Symposium • Foundations were laid for an Asian Judges Network on the Environment (AJNE). • ASEAN Chief Justices’ Roundtable on Environment, 2011 • South Asia Conference on Environmental Justice, Bhurban, Pakistan, 2012

  5. South Asia Conference on Environmental Justice in Pakistan, 2012 lead to: • Constitution of: Committee for Enhancement of Environmental Justice (CEEJ)formed. • Green Benches were formed in the SC, High Courts and District Courts. • South Asian judiciaries in attendance agreed to sign a memorandum of understanding for the coordination and collaboration on enhancing environmental justice in the region, which is expected to take place at the next conference.

  6. A J N E’s fundmanental contribution • To make judges realize that environmental justice traverses national jurisdictions. • Sets the scene for a regional and global judicial alliance to meet the environmental challenges.

  7. Expectations of a Green Judge from AJNE • To forge a communicative relationship between Asian Judges e.g., an online discussion board. The “e-law” model, where AJNE acts as a coordinator. • Developing an on-line Green Bench Book for the Asian Judges with all the latest case law and legislative developments in the region.

  8. Expectations of Green Judge from AJNE • Evolution of a common judicial strategy to combat environmental matters and set the scene for judicial and legislative reforms e.g., to merge Issues arising under CITES for judicial determination before the green benches already developed. • Development of standardized judicial data bank of cases in the region to better understand the issues and evolve a judicial strategy for the same.
