WISCONSIN’S PUBLIC HEALTH STATUTES • Public health statutes revised in 1993 WI ACT 27 • Public Health statutes are consolidated into 6 chapters • Ch. 250 - Administration and Supervision • Ch. 251 - Local Health Officials • Ch. 252 - Communicable Disease • Ch. 253 - Maternal & Child Health • Ch. 254 - Environmental Health • Ch. 255 - Chronic Disease

Wisconsin Statutes and Administrative Rules Statutory Duties of Local Boards of Health • Govern the local health department • Assure enforcement of state public • health statutes • Assure that the Local Health Department • is Level 1, 2 or 3 • Adopt necessary regulations • Report to state health agency • Meet at least quarterly

FOCUS ON CHAPTER 251 • Local Board of Health • Membership • Not more than 9 members • At least 3 members are not elected officials • “Good faith effort” to appoint a RN and a MD • Reflect diversity of the community • County human services board under 46.23 may act as a county board of health • If the County Human Services Board acts in this capacity, it shall use the word “health” in its title.

FOCUS ON CHAPTER 251 • Level of Health Departments: • Level I Health Department • Five Required Services of all Local Health Departments • Communicable Disease Surveillance • Generalized PH Nursing Program • Health Promotion • Disease Prevention • Human Health Hazard Prevention and Control • PLUS: • Full Time Health Officer • Board of Health

FOCUS ON CHAPTER 251 • Level of Health Departments: • Level II Health Department • Five Required Services (Level I ) Plus: • 7 programs or services that address at least 5 health priorities in the current state health plan • Health Officer with at least 3 years of supervisory experience in a full time position with a local health department

  12. FOCUS ON CHAPTER 251 Level of Health Departments: Level III Health Department • Agent for the state Hotel & Restaurant Program • Agent for the state Tattoo & Body Piercing Program • 14 programs or services that address at least 7 health priorities in the current state health plan

FOCUS ON CHAPTER 251 Level of Health Departments: Level III Health Department - continued • Health Officer with a Masters degree in public health, public administration or similar field and 3 years of full time experience in a Public Health agency. • Bachelor’s degree and 16 graduate credits toward a master’s degree in public health, public administration … & 5 years of experience in a full time administrative position in a public health agency.

CHAPTER 251 - continued • Local Health Officer • Qualifications • Based on education, experience and level of health department. • Full time employee • Duties • Administer local health department in accordance with statutes and rules • Enforce state public health statutes and rules • Enforce any regulations that the Board of Health adopts • Administer all funds • Appoint all necessary subordinate personnel • Investigate and supervise the sanitary conditions of all premises within the jurisdictional area of the local health department. • Have access to vital records. • Promote the spread of information as to the causes, nature and prevention of prevalent diseases

CHAPTER 251 - continued • Local Health Department • Jurisdiction • Shall extend to the entire area represented by the governing body of the county, city, village or town. • Jurisdiction does not extend into cities, villages or towns that have local health departments. • No part of any expense incurred … by a county health department may be levied against any property within any city, village ot town that has a local health department….
