  2. Establishment of the SNCHR • SNCHR was established by the Act No. 308/1993 Coll. on Establishment of the Slovak national centre for human rights, entered into force on January 1st, 1994. • supported by United Nations by Agreement between UN and government of Slovak republic

  3. Slovak national centre for human rights (SNCHR) • is an independent legal person • plays the role of a national specialized body combating all forms of discrimination and covering all grounds of discrimination with compliance to relevant articles of EU antidiscrimination directives • national human rights institution

  4. Competencies of the SNCHR SNCHR: • monitors and evaluates the observance of human rights and the observance of the equal treatment principle • collects andupon request provides information on racism, xenophobia and anti-Semitism in the Slovak Republic, • conducts research and surveys to provide data in the area of human rights; gathers and distributes information in this area

  5. prepares educational activities and participates in information campaigns aimed at increasing tolerance of the society, • provides legal assistance to victims of discrimination a manifestations of intolerance, • upon requests from natural or legal persons or on its own initiative, issues expert opinions on matters of the observance of the equal treatment principle under a special regulation, • prepares and publishes reports and recommendations on issues related to discrimination,

  6. performs independent inquiries related to discrimination, • provides library services, • provides services in the area of human rights, • prepares and publishes a report for the previous calendar year on the observance of human rights, including the equal treatment principle in the Slovak Republic.

  7. Organizational Structure of the SNCHR • Monitoring And Research Department, • Department of Education, Training And Information Services, • Department of Legal Assistance And Services, • Department of International Relations And Rights of the Child, • Regional Offices of the SNCHR

Regional offices of the SNCHR • 7 regional offices were established within the project called „Counseling Services for Building the Administrative Capacities of the SNCHR at Regional Level“ • Reason for their establishment: Since the adoption of the Antidiscrimination Act the number of applications to the SNCHR increased significantly and 90 % of them came from regions outside Bratislava from which arised an urgent need for establishing permanent SNCHR Regional Offices in each region of Slovak Republic.

  10. Antidiskriminačný zákon • zákon číslo 365/2004 Z. z. o rovnakom zaobchádzaní v niektorých oblastiach a o ochrane pred diskrimináciou a o zmene a doplnení niektorých zákonov • do právneho poriadku SR implementoval viaceré smernice Európskej únie

Chránené dôvody • pohlavie • náboženské vyznanie alebo viera • rasa • príslušnosť k národnostnej alebo etnickej skupine • zdravotné postihnutie • vek • sexuálna orientácia • manželský a rodinný stav • farba pleti • jazyk • politické alebo iné zmýšľanie • národnostný alebo sociálny pôvod • majetok • rod • iné postavenie

  12. Formy diskriminácie • priama diskriminácie • nepriama diskriminácia • obťažovanie • sexuálne obťažovanie • neoprávnený postih • pokyn na diskrimináciu • nabádanie na diskrimináciu

  13. Oblasti chránené AZ • sociálne zabezpečenie • zdravotná starostlivosť • poskytovanie tovarov a služieb • vzdelávanie • pracovnoprávne vzťahy (prístup k zamestnaniu, jeho výkon, odmeňovanie, funkčný postup, prepúšťanie, odborné vzdelávanie...)

  14. Ako sa brániť? • Sťažnosť zamestnávateľovi • Podnet na inšpektorát práce alebo na Slovenskú obchodnú inšpekciu • Podanie žaloby na súd • Obrátiť sa na Slovenské národné stredisko pre ľudské práva
