  1. Legal Advices About Divorce Divorce is a process of separation of matrimony bonds existing between two persons. This is a procedure of dissolution of marriage. People living in matrimonial bondage seek the help of the court to get separated. There are so many issues other than separation of both the parties physically. The law would decide or the parties should mutually decide on Child Custody, financial issues and property issues. On mutual consent, the divorce becomes easier. There are various reasons for applying for divorce.

  2. But when there is no mutual consent and there is a requirement for interference or mediation through law on divorce then one should approach a good and better lawyer. If the parties have a better lawyer it would be possible for them to get divorce as soon as possible. Not only that the lawyers would explain their own clients on the rights they could claim. The divorce may be claimed for different reason. One of the reasons might be either of the parties at fault (At-fault Divorce). In such situation it is the responsibility of the other party to prove the fault of the other party. The fault should be proved with evidences to the court. After verifying all the evidences the court would finally give the judgment on divorce. The various issues on divorce like child custody and financial matters would be resolved with the help of their own lawyers. It is always good to approach a well known and an experienced lawyer to speak on their behalf.

If there is mutual consent (Uncontested Divorce) and there is an agreement between the two parties regarding the various issues of child custody, spouse maintenance (Alimony), financial matters and so on, then the divorce procedure would be easy. The mutual consent and the agreement on all the other issues regarding separation would be documented and the signature of both the parties would be attained in order to record the agreement. Alimony – the spouse maintenance comes in to picture only in the case where the spouse has devoted her career for the family and mostly this would arise in the case of longer term of marriages. There are two kinds of alimony where the spouse should be supported for a short term till the spouse is equipped to continue her career. The other kind is permanent support. The spouse would be supported permanently.

Collaborative divorce is a popular method of divorce where both the parties come to an agreement regarding the custody and all the other issues with the help of an attorney who would just guide them in knowing their rights regarding divorce. The attorneys would not be allowed for further legal proceedings after the consent is obtained. The divorce being completely an emotional issue it should be handed over to a Good And Experienced Lawyer. The child custody is a more emotional and sensitive issue since it relates a child and parent bondage. The lawyer who gives advice and who speaks for the parties should not only be experienced but should be a person with good humanitarian grounds.
