Previous Process • Employer established need to fill vacancy with work permit holder (advertising and selection process) • Employer applied for work permit to allow them to take up post • Individual applied for visa for permission to enter country or remain if in country • After 5 years individual could apply for indefinite leave to remain – no longer required work permit

  3. Points Based System • System based on Australian “points based system” • UoN is now a licensed sponsor (A rated) • When we want to appoint a migrant worker we issue a sponsorship (number) • Appointee uses this to apply for visa and BIA refer to sponsorship in making visa decision • New ID/visa card

  4. The 5 tiers • Tier 1 – Highly Skilled Migrant Programme (inc post study workers scheme) • Tier 2 – generally replaces the categories who needed a work permit • Tier 3 - unskilled • Tier 4 - students • Tier 5 - sponsored researchers, “creative and sporting”

Codes of Practice • Each code includes the following: • the skilled jobs at National or Scottish Vocational Qualification (NVQ or SVQ) level 3 or above in each occupation that sponsors are allowed to issue a certificate of sponsorship for; • the minimum appropriate salary rates, as defined by the 25th percentile of the Annual Survey of Hours and Earnings (ASHE) or by an alternative code of practice; • the acceptable media and methods for meeting the resident labour market test

  8. Other features • £170 per sponsorship (tier 2) • Sponsorship immediately available on payment • Valid for 3 months • Must be issued within 6 months of placement of advert

  9. Post Recruitment • Requirement to monitor • Requirement to keep up to date contact details • Annual review of continuing eligibility
