Two Types of Sentencing • Indeterminate • Judge gives a minimum and maximum sentence • e.g. = 15-25 years • If prisoner is on good behavior, he/she can get out on parole starting on the minimum date. • PROS: • More flexible; fits various circumstances • Helps solve overcrowding prison problem • CONS: • Some argue that it’s too lenient • Two criminals who commit the same crime can have different penalties

Two Types of Sentencing • Mandatory • Judge gives whatever the state or federal law directs • No flexibility in the sentence given • PROS: • Not as complicated or confusing as indeterminate • Everyone gets the same sentence for the crime • CONS: • Can be too strict given the circumstances • Can lead to overcrowding in prisons
