  4. DEFINITIONS

  5. 340.01(24)(a) - “Implement of husbandry” • means a vehicle or piece of equipment or machinery • designed for agricultural purposes, • used exclusively in the conduct of agricultural operations • and used principally off the highway, • or a trailer-mounted bulk liquid fertilizer container

  6. 340.01(24)(b) - “Implement of husbandry” • does not include any motor truck, farm truck, road tractor, truck tractor, or farm truck tractor or such a vehicle combined with a semitrailer, trailer or farm trailer, • when the vehicle or combination is a commercial motor vehicle operated on a highway.

  7. 340.01 (16) - “Farm Tractor” • Means a motor vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry.

  8. 340.01 (17) – “Farm trailer” • Means a trailer or semi-trailer • With a gross weight greater than 3,000 pounds • Which is owned or leased and operated by a farmer • And is used exclusively for the transportation of farm products to and from the owner’s farm to the market.

  9. 340.01 (18) – “Farm truck” • Means a motor truck that is owned or leased and operated by a farmer. • And is used primarily for the transportation of: • Supplies, farm equipment and products, • On the owners farm, between his or her farms, • Or to and from market.

  10. 340.01 (18g) – “Farm truck tractor” • Means a truck tractor that is owned or leased and operated by a farmer. • And is used primarily for the transportation of: • Supplies, farm equipment and products, • On the owners farm, between his or her farms, • Or to and from market.

  11. REGISTRATION

  12. A vehicle, even though operated upon a highway of this state, is exempt from registration if any of the following apply: (7) - The vehicle is a farm tractor used exclusively in agricultural operations. (17) – The vehicle is an implement of husbandry. 341.05 – “ When vehicles are exempt from registration”

  13. The exemption does not include: • Motor truck • Farm truck • Road tractor • Truck tractor • Farm truck tractor • Farm trailer

  14. OPERATOR REQUIREMENTS

  15. No person may direct or permit a child under the age of 16 years to operate a farm tractor or self-propelled implement of husbandry on the highway unless the child has been certified by successfully completing a safety training course. 346.925 (1) – “Operation of agricultural machinery by youthful operators”

  16. 343.055 – “Commercial driver’s license waivers” • Operators of certain commercial motor vehicles are not required to hold a commercial driver’s license, if the operator holds a valid operator’s license.

  17. Farmers Exemption • The operator of the commercial motor vehicle is a farmer, • Who is using the commercial motor vehicle within 150 miles of the operator’s farm, • To transport agricultural products, farm machinery or farm supplies to or from a farm.

  18. NOTE If the farmer operates a farm vehicle outside the scope of the farm or is operating FOR-HIRE, and that vehicle meets the definition of a commercial motor vehicle, a CDL will be required.

  19. LIGHTING REQUIREMENTS

  20. 347.22 (1) – “Lamps on farm tractors and self-propelled farm implements” • No person shall operate or park a farm tractor or self-propelled farm implement upon a highway during the hours of darkness unless, • Such tractor or implement carries the lighted headlamps and tail lamps which would be required of other motor vehicles under similar circumstances.

  21. WHAT DOES THAT MEAN? It means that TWO headlamps and at least ONE red tail lamp are required!

  22. 347.24 (1) – “Lamps and reflectors on non-motor vehicles and equipment” Cannot operate an implement of husbandry during the hours of darkness, UNLESS:

  23. They have either TWOred tail lamps or TWOred reflectors displayed on the rear.

  24. During the hours of darkness, any implement of husbandry that extends 4 feet or more to the left of the centerline, MUST: • Have an amber reflector mounted on the left side, • It must face forward marking the extreme width of the implement. • Required to warn on-coming vehicles.

  25. 347.21 (1) – “Lamps and flags on trains of agricultural vehicles”

  26. During hours of darkness: • Must have a red light or red reflector located on each side of every vehicle in the train. • May also display a SMV emblem on each side, instead of a lamp or reflector.

  27. During the day: • Must have 2 red flags at least 12 inches square. • Must be displayed on the rear-most vehicle, one at each corner.

  28. Slow Moving Vehicle Emblem(SMV)

  29. EXCEPTION!!!! • If the vehicle or combination of vehicles, has an amber flashing light of at least 4 inches in diameter attached to the left rear. • NO SMV IS REQUIRED!

  30. 347.245 – “Identification emblem on certain slow moving vehicles” • Must be displayed on any vehicles or equipment, including animal-drawn equipment, which usually travels less than 25 mph. • Must be displayed day or night. • SMV emblem must be bright and clean, not FADED. • If the tractor has a clearly visible SMV emblem not blocked from view by the implement being pulled behind it, the implement is not required to have one.

  31. It is PROHIBITED to display an SMV emblem for any other purpose, such as, to mark a driveway or mailbox.

  32. All farm trucks, farm trailers, farm truck tractors and any other non-implement, MUST have: • HEAD LAMPS • TAIL LAMPS • STOP LAMPS • TURN SIGNALS • AND TRAILERS MUST HAVE “2” SAFETY CHAINS

  33. SIZE AND WEIGHT REQUIREMENTS

  34. WIDTH OF VEHICLES 348.05(1) No person without a permit therefore shall operate on a highway any vehicle having a total width in excess of 8 feet 6 inches, except as otherwise provided in this section.

  35. WIDTH OF VEHICLES 348.05(2) The following vehicles may be operated without a permit for excessive width if the total outside width does not exceed the indicated limitations: • 348.05(2)(a) • No limitations for implements of husbandry temporarily operated upon a highway in the course of its work ;

  36. WIDTH OF VEHICLES 348.05(2)(c) Twelve feet for farm tractors, except that the total outside width of a farm tractor shall not exceed 9 feet when operated on any Wisconsin highway which is part of the national system of interstate and defense highways;
