The Car Accident Checklist A car accident is a scary situation in which emotions run high – it’s hard to keep your wits about you in such a situation and consider a procedure that will give you the best advantage in the event of a lawsuit. Following our car accident checklist will not only keep you safe in the physical sense, but also it will protect you if your case goes to court.

  3. Call the Police 1 A minor accident can still cause damage to you or your car, and it’s important to file a documented police report as close to the time of the accident as possible. If at all possible, make sure you wait at the scene for the police to arrive – do not leave before speaking to them.

  4. Call an Ambulance 2 Take care of your physical well-being before doing anything else. Even if you’re not feeling any immediate signs of damage, you could have injuries whose symptoms won’t emerge until later.

  5. Collect the Other Driver’s Information 3 Name Address Phone number Vehicle make and model Vehicle license plate Insurance information

  6. Document All Injuries 4 Even minor injuries (bruises, scrapes) are important to note. Often times more serious injuries do not make themselves known until after the fact, so it’s important to note any signs or symptoms early on.

  7. Photograph the Scene 5 If you can safely do so, take pictures of the accident. Especially the following elements: Vehicle damage Injured drivers & passengers Skid marks on the road The road or intersection where the accident occurred Lights and signs near the accident

  8. Do Not Accept Responsibility 6 Avoid speaking with anyone, except police, about your car accident. You do not have to accept any responsibility on the scene. Don’t say things like, “It was my fault,” even if you think it was. Speak with your lawyer first.

  9. Do Not Leave the Scene 7 Remain at the scene until all of the emergency response personnel, police officers, and other drivers have left.

  10. Contact Your Insurance Company 8 You should notify your auto insurance company that the accident happened, but you do not need to do so immediately. Don’t worry about doing this from the accident scene, or at the hospital, or even the next day. It should be the last thing you do, and you shouldn’t provide many details to the insurance company without consulting your lawyer first.
