Alabama Power –Plant Miller Settlement • SCR operated year-round for NOx reductions at Units 3 & 4 • Comply with a 30-day rolling average NOx emissions rate limit of no more than 0.100 lb/mmBTU for Units 3 & 4 • Scrubbers operated year-round for SO2 reductions at units 3 & 4 • Comply with a 95% SO2 removal efficiency requirement over a 30-day rolling average for Units 3 & 4 • PM emission rate no more than 0.030 lb/mmBTU at Units 3 & 4 • Install & operate mercury CEMS on one unit

  4. Alabama Power –Plant Miller Settlement • Civil Penalty $100,000 • Environmental Projects Retirement of $4.9 Million worth of vintage 2007 SO2 allowances (approximately 6,577 tons SO2) • Pollution Reduction • NOx emissions 4,943 T/YR • SO2 emissions 22,788 T/YR
