  3. Original Design Consultant • International Engineering Consultants (IEC) • Began September 1999 • Phase I: Roadway Conceptual Analysis (RCA) – Duration 150 days • Phase II: Final Design – Duration 390 days

  4. Original Design Consultant Issues • Notice of non-performance in June 2004 • After the Cure Notice was issued, County staff reminded the consultant of project issues that needed to be completed, for example: • Delivery of the 100% submittal • Construction plans • Right-of-way documents • Delivery of streetscape proposal • Delivery of minor revisions to the pond 2 detail • Delivery of minor revisions within the Lake Destiny Drive intersection to change fill/slope easements to right-of-way • Delivery of volumes of joint-use pond • Submittal of stormwater permits

  5. Original Design Consultant Issues • Contract ended in September 2006 • Failure to respond to County • Failure to complete the stormwater permit • Failure to complete construction plans • Failure to provide right-of-way documents

Current Design Consultant Kimley Horn Associates • June 2007 - Continuing Design Contract • Finalize the environmental permit • Redesign the road adjacent to the radio tower near the western end of the project • Prepare all necessary documents for a Design-Build project • Budgetary restraints require completion of design phase • Right-of-way & construction phases based on funding

  7. Action Requested • Approve Sole Source Contract with Kimley-Horn Associates, Inc. for Final Engineering Design Services in the amount of $315,942.78 and issuance of a Purchase Order for $50,000.
