Case Example • In 2012, Russian Circuit Court of Arbitration ruled on several cases that may be considered landmarks in the fight against abusive tax schemes. • The case concerned a trademark buy-and-license back structure, not uncommon for Russian businesses. A Russian transferred his trademark offshore through a series of transactions. The trademark was licensed to Russian companies through a Cyprus intermediary. The tax authorities argued that the Russian company could have obtained the license directly from the Russian individual instead of going to Cyprus.
