Understanding CIL Funding and Regulation 123 List

What is the Community Infrastructure Levy (CIL)? • Levy on new development to generate funds to provide infrastructure to support growth • How it is spent is set out in ECDC CIL Governance document • Can only be spent on projects on the Regulation 123 List • Parish Council gets 15% ‘meaningful proportion’ (25% if have Neighbourhood Plan)

Regulation 123 List (R123 List) List of projects identified by ECDC in consultation with stakeholders, as necessary infrastructure to support sustainable growth and achieve corporate priorities Split into major projects and strategic projects Any stakeholder can apply for project to be included on the list Being on the R123 List doesn’t guarantee project will receive CIL funding

4. What can CIL fund? CIL Regulations state that funds must be spent on ‘infrastructure necessary to support growth’ CIL can only be spent on capital projects, although associated revenue spending to maintain those capital items is also permissible It can be used to increase the capacity of existing infrastructure or to repair failing infrastructure, if necessary to support development CIL cannot be used to fund solutions to existing problems i.e. traffic management or on repairs to existing infrastructure in an area that hasn’t experienced housing growth

5. R123 List application process Identify project, develop project plan, secure match funding and stakeholder support Submit Expression of Interest form Joint Steering Group will score application - if it meets criteria will make recommendation to Full Council Notification of Full Council decision Once project is established – apply to ECDC to release funds

6. Pre-application criteria In order to be eligible for CIL funding a project must: Be necessary to support local growth Cost between £50,000 - £2,000,000 Be deliverable within 3-5 years Match funding and a financial contribution from applicant must have been secured If the project is highways or education related, the application must be accompanied by a letter of support from the relevant CCC department.

7. What should an application include? Evidence of need and stakeholder support Reference to ECDC corporate priorities, Local Plan, the Local Transport PlanCambridgeshire Health & Wellbeing Strategy objectives and policies (if applicable) Details of project costs – including amount of CIL funding required Details of match funding – including some financial input from organisation making application

Successful Parish Council projects • Lode to Quy Cycle Path - Lode and supported by Swaffham Bulbeck PC • Wicken-Soham-Ely Cycle Path – Soham T C and Wicken PC • Both had: • Evidence of match funding • Good fit with ECDC corporate priorities, Local Plan and the Local Transport Plan • Sustrans Feasibility report – looking at delivery • Wide area of impact
