New Part C Regulations • Until September 2011, the IDEA 2004 federal statute had regulations for Part B • Part C regulations were from IDEA 1997; released in 1999 • New Part C regulations released September 28, 2011 • Became effective October 28, 2011; implementation by July 1, 2012 • States must revise their policies and procedures to align with the new Regs • Many states currently are undergoing a period of public comment on their revised P & P

Process for New Part C Regulations • Potential revisions to Part C regulations proposed in May 2007 • The public had an opportunity to comment on the potential revisions • Public comments compiled • OSEP accepted or rejected comments; amended some potential regulations • OSEP released the new Part C regulations, with their comments on the comments, 9/28/11 - http://www.gpo.gov/fdsys/pkg/FR-2011-09-28/pdf/2011-22783.pdf
