DOT STRATEGIC PLAN UPDATE Task 17-2: FY 2018-2022 Strategic Plan • The Department released its Strategic Plan for FY 2018-2022 in February 2018. https://www.transportation.gov/dot-strategic-plan • The MCSAC provided feedback on the current FMCSA strategic goals and objectives and recommendations for future goals and objectives to align with DOT's plan.

DOT Strategic Goals • SAFETY Reduce Transportation-Related Fatalities and Serious Injuries Across the Transportation System. • INFRASTRUCTURE Invest in Infrastructure to Ensure Mobility and Accessibility and to Stimulate Economic Growth, Productivity and Competitiveness for American Workers and Businesses. • INNOVATION Lead in the Development and Deployment of Innovative Practices and Technologies that Improve the Safety and Performance of the Nation's Transportation System. • ACCOUNTABILITY Serve the Nation with Reduced Regulatory Burden and Greater Efficiency, Effectiveness and Accountability.

FMCSA REGULATIONS UPDATE Task 17-3: Regulatory Review The MCSAC provided recommendations to the Agency concerning: • Implementation of Executive Orders 13771, “Reducing Regulation and Controlling Regulatory Costs” (82 FR 9339, February 3, 2017) and • 13777, “Enforcing the Regulatory Reform Agenda” (82 FR 12285, March 1, 2017).

  5. 13771 Deregulatory Actions • VA Docs (Final Rule) • Annualized cost savings of $147,000. • ELDT Class B to Class A CDL Upgrade (NPRM): • Establishes a streamlined theory training curriculum for individuals upgrading from a Class B to A CDL. • Annualized cost savings of $15 million • Application for Employment • Reduces paperwork burdens by proposing changes to eliminate 391.21 which requires motor carriers to have a driver complete an application for employment that includes specific information. • Third Party Commercial License Testers • Eliminates the 49 CFR 383.75(a)(7) restriction that prevents a third party skills examiner from administering a CDL test for a student he/she has provided skills training to.

  6. 13771 Deregulatory Actions • Record of Violations • Eliminates the requirement in 391.27 that a driver complete a list of violations annually to reduce regulatory burden. • Motor carriers are already required to obtain a copy of the driver’s driving record annually making this requirement redundant. • Military Licensing and State CDL Reciprocity • Allows certain military drivers to apply for State CDLs without taking and passing the general knowledge test which would reduce regulatory burdens on these eligible veterans. • Implements part of section 5401 of the FAST Act.

  7. 13771 Deregulatory Actions • Commercial Learner's Permit Validity • Allows States to issue a CLP for up to 1 year. Rather than 6 months with a 6 month renewal. • Qualifications of Drivers: Diabetes Standard • Amends FMCSA´s medical qualification standards to allow drivers with insulin-treated diabetes mellitus to operate commercial motor vehicles in interstate commerce, without seeking an exemption from the FMCSRs. • Action is required by the Safe, Accountable, Flexible, Efficient, Transportation Equity Act (SAFETEA-LU).

  8. New Rulemakings • Human Trafficking Prohibition • Permanently disqualifies individuals from operating CMVs after commission of felony human trafficking using a CMV. • Extension of Compliance Date for Lease and Interchange of Vehicles: Motor Carriers of Passengers • Extends the compliance date of the Bus Leasing Final Rule (published in 2015) from January 1, 2019 to January 1, 2021. • Driver Qualifications: Revising the Vision Standard • Will propose revision of physical qualification standards related to vision, reducing burdens on monocular vision individuals, motor carriers, and the Agency. • Autonomous Driving Systems • ANPRM in development.
