THE LAW HAS NEVER BEEN PRECISELY DEFINED OR CODIFIED AND IS DIVIDED INTO CRIMINAL LAW (DIRITTO PENALE)AND CIVIL LAW. • A PERSON ACCUSED OF A CRIME IS USUALLY JUDGED ACCORDING TO THE PRINCIPLES OF COMMON LAW. • THE COMMON LAW IS BASED ON CUSTOMS (CONSUETUDINE) AND INTERPRETED IN COURT CASES BY JUDGES.
THE TRIEL • ONE OF THE MOST IMPORTANT PRINCIPLE IN BRITISH LAW IS THET THE ACCUSED IS ALWAYS CONSIDERED INNOCENT UNTIL HE HAS BEEN FOUND GUILTY AND CONVICTED BY THE COURT. • AN IMPORTANT ASPECT OF BRITISH JUSTICE IS TRIEL BY JURY, BOTH IN CRIMINAL AND SOMETIMES CIVIL CASES.
THE JURY IS MADE UP OF 12 MEN AND WOMEN AGED 21/60 WHO ARE HOUSEHOLDER, BRITISH SUBJECTS, LITERATE AND HAVE NO PREVIOUS CRIMINAL RECORD. • THE JUDGE ACCEPTS THE MAJORITY VERDICT OF GUILTY AND IMPOSE A SUITABLE SENTENCE- A FINE OR PRISON.
THE POLICE • THERE ISNO NATIONALPOLICE FORCE IN BRITAIN, BUT A NUMBER OFSMALL BODIESCLOSELY LINKED TO LOCAL GOVERNMENT, UNDER THE JURISDICTION OFHOME OFFICE • THE MOST FAMOUSE IS THE METROPOLITAN POLICE FORCE WITH ITS HEADQUARTER IN NEW SCTLAND YARD.
THE TASKOF THE POLICE IS TOPRESERVELAW AND ORDER. • THE POLICE HAVE THE RIGHT TO QUESTION ARRESTED OR SUSPECTED PEOPLE, BUT CANNOT COMPEL THEM TO GIVE INFORMATION. • THE POLICE IS UNARMED EXCEPT IN VERY SPECIAL CASES. • PUBLIC OPINION OF THE POLICE FORCE IS VERY HIGH AND FULL COLLABORATION IS GIVEN IN HELPING THEM TO CARRY THEIR DUTIES.
