FullName (ii)nosurrogacy orsurrogacy proceduresshallbeconducted,undertaken,performedoravailedof, exceptforthefollowingpurposes,namely: → PhoneNumber ContactUs (a)whenanintendingcouplehasamedicalindicationnecessitatinggestationalsurrogacy: Providedthatacouple ofIndianoriginoranintendingwomanwhointendstoavailsurrogacy, shallobtainacertificateofrecommendationfromthe Board onanapplicationmadebythesaid personsinsuchformandmannerasmay beprescribed. Email AppointmentDate Explanation.—Forthepurposesofthissub-clause anditem(I)ofsub-clause(a)ofclause (iii)the expression“gestationalsurrogacy”meansapracticewherebyasurrogatemothercarries7achild forthe intendingcouple throughimplantationofembryo inher wombandthechild is not geneticallyrelatedtothesurrogatemother; Message SUBMIT (b)whenitisonlyforaltruisticsurrogacypurposes; whenitisnotforcommercialpurposesorforcommercialisationofsurrogacyorsurrogacy procedures; whenitisnotforproducingchildrenforsale,prostitutionoranyotherformofexploitation; and ALTRUISTICSURROGACY (e)anyotherconditionordiseaseasmay bespecifiedbyregulationsmadebytheBoard; AltruisticSurrogacyTreatmentisLegalin India. EligibleIntendedParentshave successfullygotlegalpermissionsto do surrogacy treatmentwithwilling altruistic Intendedsurrogatemother. Todoyour surrogacy treatmentlegally,please contactusorwhatsappat 9267937367. (iii)nosurrogacy orsurrogacyproceduresshall beconducted, undertaken,performedorinitiated, unlesstheDirectororin-chargeofthesurrogacyclinic andthe personqualifiedto do so are satisfied,forreasons toberecordedinwriting,thatthe followingconditionshavebeenfulfilled, namely:— (a)the intendingcouple isinpossessionofa certificateofessentialityissued bytheappropriate authority,aftersatisfyingitself,forthe reasons toberecordedinwriting,aboutthe fulfilmentof the followingconditions,namely:— (I)acertificateofa medicalindicationinfavourofeitherorbothmembersoftheintending coupleor intendingwomannecessitatinggestationalsurrogacyfrom aDistrictMedicalBoard. Explanation.—Forthepurposes ofthisitem,the expression“DistrictMedicalBoard”meansa

  2. medicalboardunderthe ChairpersonshipofChiefMedicalOfficerorChiefCivilSurgeonorJoint DirectorofHealthServicesofthedistrictandcomprising ofatleasttwo otherspecialists,namely, thechiefgynaecologistorobstetricianandchiefpaediatricianofthedistrict; Pleasevisit https://www.indiacode.nic.in/handle/123456789/17046tounderstandthelegalprocess fordoingsurrogacyinIndia. (II)anorder concerningtheparentageand custodyofthe child tobebornthroughsurrogacy,has beenpassed by a court oftheMagistrateofthefirstclassor aboveonanapplicationmadeby the intendingcouple orthe intendingwomanand the surrogate mother,whichshallbe thebirth affidavitafterthesurrogatechildisborn; and(III)aninsurancecoverageofsuchamountandin suchmanner asmaybe prescribedinfavourofthesurrogatemotherforaperiodofthirty-six monthscoveringpostpartumdeliverycomplicationsfromaninsurancecompanyoranagent recognisedbytheInsurance • RegulatoryandDevelopmentAuthorityestablishedundertheInsuranceRegulatoryand DevelopmentAuthorityAct,1999(41of1999); • the surrogatemotherisinpossessionofaneligibilitycertificateissuedbytheappropriate authorityonfulfilmentofthe followingconditions,namely:— • nowoman,otherthananevermarriedwomanhavingachildofherownandbetweentheageof25to35years onthedayofimplantation,shallbeasurrogatemotherorhelpinsurrogacybydonating hereggoroocyteorotherwise; • a willingwomanshallactasasurrogatemotherandbepermittedtoundergosurrogacy proceduresaspertheprovisionsofthisAct:8Providedthatthe intendingcouple ortheintending womanshallapproachtheappropriateauthoritywithawillingwomanwhoagrees toactasasurrogatemother; • nowomanshallactasa surrogatemotherbyprovidingher owngametes; (IV)nowomanshallactas asurrogatemothermorethanonceinherlifetime:Providedthatthenumberofattemptsforsurrogacyproceduresonthesurrogatemothershallbesuchas maybeprescribed;and → ContactUs • (V)acertificateofmedicalandpsychologicalfitness for surrogacy andsurrogacyprocedures fromaregistered medicalpractitioner; • aneligibilitycertificateforintendingcoupleisissuedseparatelybytheappropriateauthority on fulfilmentofthefollowingconditions,namely:– • theintendingcouple are married and betweentheageof23to50yearsincaseoffemaleand between26to55 yearsincaseofmaleonthedayofcertification; • the intendingcouplehavenothadanysurvivingchild biologicallyorthroughadoptionor throughsurrogacy earlier:Provided thatnothingcontainedinthisitem shallaffectthe intending couplewhohavea child andwhoismentallyorphysicallychallenged or suffersfromlifethreateningdisorderorfatalillnesswithnopermanentcureandapprovedbytheappropriate authoritywithduemedicalcertificate from a DistrictMedicalBoard; and • suchotherconditionsasmaybespecifiedbytheregulations. • Prohibitionofconductingsurrogacy.—Nopersonincludinga relative orhusbandofasurrogatemotheror intendingcouple or intendingwomanshallseekorencourageto conductany surrogacyorsurrogacyproceduresonher exceptforthe purpose specified in clause(ii)ofsection4. • Writteninformed consentofsurrogate mother.—(1)Nopersonshallseekor conductsurrogacyproceduresunlesshehas— • explainedallknownside effectsandaftereffectsofsuchprocedurestothe surrogate mother concerned;and • obtained intheprescribedform,thewritteninformedconsentofthe surrogate motherto undergosuchproceduresinthelanguagesheunderstands.

  3. (2)Notwithstandinganythingcontainedinsub-section(1),thesurrogatemothershallhavean optiontowithdrawherconsentforsurrogacybeforetheimplantationofhumanembryoinher womb. Prohibitiontoabandonchildbornthroughsurrogacy.—Theintendingcoupleorintending womanshallnotabandonthechild,bornoutofa surrogacyprocedure,whetherwithinIndia oroutside,foranyreasonwhatsoever,includingbutnotrestrictedto,anygeneticdefect, birthdefect,anyothermedicalcondition,thedefectsdevelopingsubsequently, sexofthe childorconceptionofmore thanonebabyandthelike. Rightsofsurrogatechild.—A childbornout ofsurrogacyprocedure,shallbedeemedtobea biologicalchild oftheintendingcoupleorintendingwomanandthe said child shallbeentitledtoallthe rightsandprivilegesavailabletoa naturalchild underanylawfortime beinginforce9 Number ofoocytesorhumanembryostobeimplanted.—Thenumberofoocytesorhuman embryostobeimplantedinthe uterusofthesurrogatemotherforthepurpose ofsurrogacy, shallbesuchasmay beprescribed.
