Republic of Serbia Ministry of Agriculture, Trade, Forestry and Water Management LAW ON MARKET SURVEILLANCE (DRAFT) • the implementation of activities and measures of market surveillance • market surveillance in the area of jurisdiction of certain market surveillance authorities • the cooperation of market surveillance and customs authority, • information exchange and communication with stakeholders • general principles and application of mark of conformity, • planning and monitoring the activities of market surveillance and coordination in the field of market surveillance

Маркет surveillance authority: Republic of Serbia Ministry of Agriculture, Trade, Forestry and Water Management • the Ministry in charge of agriculture, trade, forestry and water management issues • the Ministry responsible for environment, mining, construction and spatial planning • the Ministry competent for labour affairs • the Ministry responsible for health issues • the Ministry governing infrastructure and energy • the Ministry competent for telecommunication issues • the Ministry responsible for interior affairs • the Ministry in charge of metrology • as well as other bodies, organization i.e. independent regulatory body that carries the implementation of activities, that is, undertakes measures of market surveillance

Republic of Serbia Ministry of Agriculture, Trade, Forestry and Water Management Market surveillance relates to the activities implemented and measures undertaken by the market surveillance authorities to guarantee the conformity of the products with the requirementsregulated by relevant regulations and to ensure that products do not endanger health, safety and other aspects of public interest

MARKET INSPEKTORATE (SCOPE of MS) • electrical equipment intended for use in defined voltage limits; • simple pressure vessels; • construction products; • electromagnetic compatibility for products; • equipment for personal protection; • household gas appliances; • warm water boilers on liquid or gaseous fuels; • oil and oil products; • machinery; • lifts; • radio and telecommunication terminal equipment; • motor vehicles; • chemicals and biocide products consistent with special regulations; • textile, textile products, and footwear; • crystal glass; Republic of Serbia Ministry of Agriculture, Trade, Forestry and Water Management

General framework for market surveillance is harmonized with particular provisions of Regulation 765/2008/EC, which in particular refers to: • public administration authority competences and measures that could be taken in accordance with LTRP- article 34 (that means: withdrawal of products, repeal of products, provision of information, testings...) • compentences and measures undertaken in case of dangerous products prescribed in the Law on general product safety • It is important to mention that the Law on General product safety also stipulates basic rules for establishment of Rapex • National provisions regarding accreditation also contain basic principles of Regulation 765/2008, as this Regulation also regulates accreditation issues Republic of SerbiaMinistry of Agriculture, Trade, Forestry and Water Management

Law on General Product Safety (“Official Gazette of the Republic of Serbia”, No 41/09): • transposes the provisions of the Directive on General Product Safety (2001/95/EC), • stipulates basic rules for establishing of Rapex (rapid information exchange system) Republic of SerbiaMinistry of Agriculture, Trade, Forestry and Water Management

MATFWM- MIis in charge of/responsible for: • activities and measures that should ensure that non-food products meet the requirements defined by relevant regulations and that they do not endanger the health, safety and other aspects of public interest (market surveillance) • general product safety, which includes non-food consumer / final products • Coordination within the Rapid System of Exchange of Information on dangerous (non-food) products (NEPRO), which in the further development should be integrated into the system of exchange of information on dangerous products in the European Union and informing the EU Commission (RAPEX) Republic of SerbiaMinistry of Agriculture, Trade, Forestry and Water Management

  12. The Protocol on Cooperation has been signed and the Market Inspection works closely and successfully with: • Ministry of Economy and Regional Development • Customs Administration • other MSA (LI, SI) • There are initiatives to improve information infrastructure and cooperation between the competent market surveillance bodies and Customs Administration, judicial bodies and bodies that have infrastructure and databases available for making the work of market surveillance more effective Republic of SerbiaMinistry of Agriculture, Trade, Forestry and Water Management
