Salient Features • APPROVAL OF COLLEGES OFFERING TECHNICAL EDUCATION BY UNIVERSITIES REGULATION, UGC Regulations 2014 (released on 14 March 2014) • In view of the judgment of the Hon’ble Supreme Court vide Civil Appeal No. 1145 of 2004 and Civil Appeal Nos. 5736-5745 of 2004 whereby the authority of All India Council for Technical Education (AICTE) to grant approval to colleges, affiliated to universities, conducting technical education has been negated;

Salient Features • To promote and coordinate university education including technical education, and for the determination and maintenance of standards of teaching, examination and research in universities, especially in technical education, the UGC has brought in a new set of regulations called UGC (Affiliation of Colleges offering Technical Education by Universities) Regulations, 2014.

  4. Salient Features • As per the regulations, universities need to ensure mandatory accreditation of the technical colleges by NAAC and their programmes by NBA as per relevant regulations of UGC as amended from time to time. • New technical colleges should be granted affiliation subject to the condition that they furnish an undertaking to apply for assessment to NBA within six months from the date of issue of Letter of Intent (LOI).

Salient Features • Universities should also ensure that all necessary approvals including 'No Objection' certificate are obtained by the promoter, be it government or private society/trust, before issuing LOI. All technical colleges which are more than six years old should apply for accreditation to NAAC and their programmes by NBA within six months of issue of these regulations.

  6. Salient Features • Technical institutes will now have to go for dual accreditation : These institutes will have to get an approval from the National Assessment and Accreditation Council (NAAC) and the programmes offered by them have to be assessed by the National Board of Accreditation (NBA).

  7. Salient Features • The process of approval of new institutes, earlier done by the AICTE, has been merged with that of the affiliation process, which will be done by universities. • They will not only process new applications, but also the clear extension of the existing ones.

  8. Salient Features • Subscription of e-journal packages which mandatory as per AICTE rules is now changed asDesirable. • The Regulations do not mention anything about those technical colleges which are already granted permanent affiliation by the affiliating university, prior to these regulations.

  9. . PROVISION FOR NEW COLLEGES IN 2014-2015 • Planned new engineering colleges this year, have to wait another year, since the UGC has decided to observe a one year moratorium on affiliation to fresh institutions. Apart from this, the UGC has also decided not to allow increase in intake in existing engineering colleges. • The decision is taken considering that thousands of seats in engineering colleges are lying vacant in recent years, after the admission process was over.

  10. UGC to penalize affiliating universities over poor quality of colleges • Procedure to submit compliance report. • NAACand their programmes by NBA : mandatory for technical colleges. • Violation of these regulations, UGC shall take such action as it may deem fit, including – withholding the grant to the technical college and / or delistingthe said technical college from the list of colleges maintained by UGC.

Clause 2.2.6 Financial Norms : Provision • The total amount in case of establishment of a technical college shall be calculated by adding the amounts specified for each programme applied for. • The amount deposited by the technical college shall remain with the university for at least 10 years which may be extended as per the regulations. • The interest accrued on this deposited amount shall be credited to the university.

  12. Clause 2.2.6 Financial Norms • Provision : contd.. The principal amount shall be returned to the Society / Trust / Company on expiry of the term. However, the term of the deposited amount could be extended for a further period as may be decided on case to case basis and / or forfeited in case of any violation of norms, conditions, and requirements and / or non-performance by the technical college and / or complaints against the technical college.

  13. Suggestions Clause 2.2.6 Financial Norms Suggestion concerning the provision of Financial Norms - • Since the amount of deposit is belonging to the Institute, the interest accrued on this deposit shall be credited to the respective Institute only. • In the case of any violation of norms, conditions by the institute, before forfeiture of the deposit by the UGC, due notice and hearing shall be given to the concerned institute.

  14. Suggestions Appendix-7 : Faculty Requirements & Cadre Ratio • In the cases where the actual number of students admitted fall below the sanctioned intake, in such cases, by calculating the faculty – student ratio considering the sanctioned intake, up to 80% of the faculty strength shall be considered as permissible.

  15. Suggestions Appendix-8 : Faculty Cadre & Qualifications • The entry norms for qualifications and experience for the persons from industries shall be drafted separately. • For encouraging industry-institute interaction and academic excellence, the people from industry, researchers, eminent scientists, experts in the various fields shall be considered.

  16. Suggestions Clause 2.2.3.4 Change of Site/Location read with Clause 2.2.1.1New College • Use of land in two pieces located on two sides of a road should be permitted and maximum distance should be specified. There are some institutes in India having the facilities in different locations separated by roads. • Hence facilities of an institute at two different locations may please be considered.

  17. Suggestions accepted / not considered • The above mentioned suggestions were made by the Association of the Managements of Private Un-aided Engineering Colleges in Maharashtra, Nasik, but these are not considered/incorporated. • However, the suggestion concerning mandatory subscription of e-journal packagesis changed as Desirable e-journals.

  18. NO CHANGE in the other Norms & Requirements for affiliation / renewal of affiliation of technical colleges by Universitiesexcept those cited above. .

  19. . • Sec. 4 Mandatory accreditation of technical colleges seeking affiliation / renewal of affiliation from Universities • Universities shall ensure mandatory accreditation of the technical colleges by NAAC and their programmes by NBA as per relevant regulations of UGC as amended from time to time. • All technical colleges which are more than six years old shall apply for accreditation by NAAC and their programmes by NBA within six months of issue of these regulations. • All technical colleges which are accredited by NAAC orwhose programmes are accredited by NBAshall be considered for permanent affiliation subject to fulfilment of other conditions as laid down by the university concerned.

  20. ANNEXURE Norms and procedures for affiliation by University for a new college offering technical education, change of site / location, closure of a college offering technical education, conversion of a Women’s College into Co-ed College • A college proposing to offer technical education shall first seek affiliation from the university before starting the academic activities. • For the above purpose, the university shall follow the norms and procedures as outlined in the regulations.

  21. Clause 2.2.2.5 of the Annexure Funds position of the applicant college in the form of FDRs* on the date of scrutiny(same as earlier provisions by AICTE)

  22. Other requirements • Land Requirements as per Appendix 4 • Teaching faculty as per norms & possessing prescribed qualifications • Computers, Software, Internet and Printers, laboratory equipments and experiments, books and library facilities, Acquisition of desirable E- Journals for each Programme as given in Appendix 5 • essential and desired service requirements shall be as given in Appendix 6

  23. Processing Fees for Change in Site / Location, Closure of Institute and conversion of Women College to Co-Ed college.

  24. Policy of the State Government The applications for establishing new colleges and extension of affiliation for existing colleges may be considered by the university concerned as per the policy of the State Government.

  25. New technical colleges granted letter of affiliation and the existing technical colleges granted affiliation for introduction of new programme(s), shall comply with appointment of teaching staff and Principal as the case may be, as per relevant UGC Regulations regarding minimum qualifications and pay scale etc, and other technical supporting staff & administrative staff as per the schedule prescribed by the university. contd..

  26. Technical colleges shall appoint supporting technical and administrative staff strictly in accordance with the methods and procedures of the affiliating university, State Government concerned. • The information about the appointments of staff in the prescribed format shall also be uploaded on the web portal of university. • In no circumstances, unless the appointment of all teaching and other staff is in place, the technical colleges shall start the courses

  27. Clause 2.2.11 of the AnnexureTime Schedule for processing of applications • The affiliating university shall notify through a Public Notice published in the leading newspapers and through uploading on the university web-portal regarding cut off dates for various purposes including receipt of applications and processing thereof from time to time. The time schedule mentioned in the Public Notice shall be final and binding.

  28. Appendix 14 Composition of Board of Governors on university affiliated Institutions • a) Chairman of the Trust • b&c)Twomembers (nominated by Trust / Society) • d) Nominee of the University • e) Two industrialists/ technologists/ educationists nominated by the Vice Chancellor. • f) Two Nominees of State Govt. • g) Principal of College : Member-Secretary • h) Twofaculty members The Number of members can be increased by adding members 1:1 but shall not exceed 21.

  29. AICTEnotification dt.29/01/2014 As per this notification - • It shall be mandatory for each technical institutions, University Depts to get all its its programs / courses accredited by the NBA after passing out of two batches or six years, whichever is earlier. • It shall be mandatory to apply for Reaccreditation six months before the expiry of the accreditation period.

  30. AICTEnotification dt.29/01/2014 As per this notification - • Accreditation agency shall publish on its website the final accreditation together with all documents based on which such accreditation was given to the program / course. • Application for Accreditation is to be decided within six months. • NBA to impose penalties on defaulting institutions.
