  2. HISTORY Legislation was passed during the 1998 Legislative Session. • Implementation deadline January 1, 1999

  3. History • 2001 – change in requirements to upgrade from motorcycle inst. permit to restricted motorcycle minor’s permit. • 2004 - change the hours a teen can drive from 6 am – 8 pm to 6 am to 10 pm. • 2007 – 30 day grace period on instruction permit

  4. Stages of Licensure • Instruction Permit • Restricted Minor’s Permit • Operator License

  5. Instruction Permit (valid for one year) • Issued to applicants between 14 and 18 years of age • Written approval of parent or guardian required • Vision and Knowledge testing required • If the instruction permit expires, the 180 days starts over • 30 day grace period

  6. Instruction Permit (valid for one year) • Must be held for 180 continuous days • With successful completion of an approved driver education course, the Instruction Permit requirement is reduced to 90 days.

  7. Instruction Permit (valid for one year) Permit Holder must be accompanied by a licensed operator who is at least 18 years of age who has had at least one year of driving experience and who is occupying a seat besidethe driver between the hours of 6 AM – 10 PM Permit Holder must be accompanied by a parent or guardian who is occupying a seat besidethe driver from 10 PM – 6 AM

  8. Motorcycle Instruction Permits • Length of instruction permit is 1 year. • Must hold Instruction permit for 180 days. • If applicant successfully completes an approved driver education course and a motorcycle safety course, the instruction permit requirement is decreased from 180 days to 30 days (Motorcycle only) • Motorcycle Instruction Permit not required if applicant is holding a restricted minor’s permit or operator’s license.

  9. Motorcycle Instruction Permit • May drive from 6 a.m. to 8 p.m. if the permit holder is accompanied by a licensed motorcycle operator who is at least eighteen years of age, who has at least one year of driving experience, and who is driving another motorcycle along with the permit holder.

  10. Motorcycle Instruction Permit • No motorcycle instruction permit holder may carry another person on the motorcycle.

  11. Restricted Minor’s Permit • Issued to applicants between 14 and 16An individual up to the age of 18 may hold a restricted minor’s permit • Must have met all the conditions of the Instruction Permit • No traffic convictions 6 months prior to application date

  12. Restricted Minor’s Permit • Must have written approval of parent/guardian • Automatically converts to Operator License upon reaching age 18

  13. Restricted Minor’s Permit • Permit holder may drive without supervision from 6 a.m. to 10 p.m. with parent or guardian’s permission. • May drive between 10 p.m. and 6 a.m. if the seat next to the permit holder is occupied by the minor’s parent or guardian.

  14. Motorcycle Restricted Minor’s Permit • May operate during the hours of 6 a.m. to 8 p.m. if the motorcycle is being operated with the permission of the holder's parents or guardian.

  15. Operator License • Must be 16 years old • Must have met all the conditions of the Instruction PermitRestricted permit is not required if the person is holding an instruction permit and is 16 years old

  16. Operator License • No traffic convictions 6 months prior to application date • Must have written approval of parent/ guardian • Full driving privileges with no restrictions

  17. PenaltiesDriver under 16 • Felony or Class 1 Misdemeanor (Examples: DWI, Vehicular Homicide)DL suspended until the 16th birthday

Penalties Driver under 16 • Conviction for any other traffic violation or violation of the restrictionsDL suspended for 30 days • Violations that don’t result in a suspension • Operating on private land without permission of the owner 32-14-9.1 • Unsafe vehicle 32-21-27 • Operating on interstate at less than 40 MPH. 32-25-5 • Fail to turn in a manner as directed by DOT or local authorities. 32-26-20 • Littering from a motor vehicle 34A-7-7

  19. Penalties Driver under 16 • 2nd conviction for traffic violation or violation of the restrictions DL suspended for 90 days or until the 16th birthday, whichever is longer

  20. Penalties Driver over 16 driving on a Restricted Minors’ Permit • Conviction for violation of the restrictions of the licenseDL suspended for 30 days regardless of which offense
