The Proposal Form • Developed by the A/E • Completed & submitted by bidder: • The form: (see handout) • Indicates contractor’s desire to perform the work • Establishes intent to enter into a contract • Represents an “offer” to do work at a given price • Prices can be stated in either unit cost or lump sum figures • Contract duration is specified • Indicates contractor is to begin work within a specified time after written notice of award of contract **Award of contract is communicated via Notice Of Award (See Handout)

  3. General Conditions • Some stipulations of a contract are often the same for all contracts. • “Boilerplate” documents have been created to establish procedures and apply them to ALL contracts. (ASCE & AIA) • These provisions are referred to as General Conditions.

  4. Definitions From General Conditions Handout: What are the contract documents? What is the contract? What is “The Work”? What is “The Architect? What is “The Owner”? Items in the General Conditions

  5. The General Conditions Preliminary matters: For example: • Owner shall provide surveys • Owner shall secure any easements • Architect shall have access to work • Contractor shall secure & pay all permits, fees & licenses necessary for work

  6. The General Conditions • Contractor’s Liability Insurance Requirements • Testing & Inspection Matters • Changes In Work • Payments to Contractor • Conditions For Termination of Contract • Owner’s Right to Stop Work

  7. The General Conditions May contain non-standard inclusions as Architect/Engineer deems necessary: • Protection of existing structures • Handling of hazardous materials

  8. Special Conditions • In addition to General Conditions, there may be the need to define procedures for “special conditions” • For example: • Storage of equipment sensitive to the environment • Site access issues (off-shore work, etc.) • Local business access • Pedestrian traffic access/protection
