  4. 1] Last September this banker was kidnapped for ransom. The following events occurred in connection with this kidnapping:

  5. 2] On September 9th, LAZLO TOTH...

  6. 3] HANS LUFF...

  7. 4] PETER SCHMIDT...

  8. 5] …and NICK TODAS, discussed their need to obtain...

  9. 6] $50,000 in cash to purchase a restaurant. They discussed various legal possibilities to obtain this money.

  10. 7] The next day, September 10th, TOTH, SCHMIDT, and LUFF met again and discussed doing various crimes to obtain the cash for purchasing the restaurant. They decided to kidnap a banker for $50,000, in ransom.

  11. 8] Later that day, SCHMIDT and TOTH questioned a close friend of TOTH’s,...

  12. 9] ...JIM RUPERT, about the name and work hours of a banker who lived next to RUPERT. RUPERT identified...

  13. 10] HOWARD STARKS as the banker.

  14. 11] On September 11th, SCHMIDT and LUFF hired GEORGE KING, a private investigator, to follow the banker, STARKS.

  15. 12] On September 12th, LUFF and his girlfriend, ANN TIBOR, rent a small van for a week, in her name...

  16. 13] and gave the van to him. He told her he needed it for his work.

  17. 14] On September 17th, SCHMIDT asked RUPERT to use his house so that SCHMIDT could observe the banker coming and going from the banker’s residence.

  18. 15] RUPERT asked what was going on and was told that…

  19. 16] ...SCHMIDT intended to kidnap the banker.

  20. 17] RUPERT told SCHMIDT that SCHMIDT could only use his house to observe the banker.

  21. 18] The next day, September 18th, SCHMIDT purchased two stolen handguns from...

  22. 19] ...DAVID RUSH, a criminal associate of SCHMIDT’S.

  23. 20] On September 19th, LUFF, TOTH, TODAS, and SCHMIDT, met again to discuss the purchase of a restaurant.

  24. 21] TOTH told TODAS that they would soon have $50,000 to purchase the restaurant.

  25. 22] Later that day, GEORGE KING, the private investigator, reported to LUFF...

  26. 23] …that the banker stays late at work on Tuesday and Thursday and that he drives a red BMW.

  27. 24] Later that day, LUFF and SCHMIDT were discussing their kidnapping plan when LUFF’S girlfriend,...

  28. 25] ...ANN TIBOR, overheard some of the details of the kidnapping.

  29. 26] LUFF asked TIBOR to assist them by driving the rented van to the vicinity of the bank...

  30. 27] …on the day of the kidnapping. TIBOR agreed.

  31. 28] On the morning of September 20th, SCHMIDT used the inside of RUPERT’S house...

  32. 29] …to observe the banker, STARKS, as he left his house. RUPERT was not at home.

  33. 30] SCHMIDT used RUPERT’S phone to report to LUFF that the banker was driving his red BMW.

  34. 31] At noon that day, ANN TIBOR called LUFF...

  35. 32] …and said that she had returned the rental van to the rental agency and that she would not assist them.

  36. 33] At 6:30, LUFF and SCHMIDT successfully kidnapped STARKS as he left the bank.

  37. 34] SCHMIDT and LUFF negotiated with bank officials, who paid $50,000 in cash for the release of STARKS.

  38. 35] STARKS was released soon thereafter.

  39. 36] On September 22nd, SCHMIDT, TOTH, and LUFF met with NICK TODAS...

  40. 37] …and gave him a $50,000 check to purchase the restaurant.
