  7. IMO response to BALLAST WATER issue: Res. A.774(18) in 1993, revoked by Res. A.868(201) in 1997 Ballast Water Management Convention, adopted 2004(needs 30 countries / 35 % world GT to enter into force)

D-1: Ballast water exchange standard 95 % volymetric exchange; or 3 times pumping through the volume of each tank Section B – Management and control requirements for ships Reg. B-4: Ballast water exchange -200 nm and 200 m depth, or if not possible - 50 nm and 200 m depth, or if not possible - in areas designated by the Port State Ballast Water Exchange shall only be undertaken when safety of the ship is guaranteed

UNCLOS Article 195: Duty not to transfer damage or hazards or transform one type of pollution into another In taking measures to prevent, reduce and control pollution of the marine environment, States shall act so asnot totransfer, directly or indirectly, damage or hazards from one area to another ortransform one type of pollution into another Article 196: Use of technologies or introduction of alien or new species • States shall take all measures necessary to prevent, reduce and control pollution of the marine environment resulting from the use of technologies under their jurisdiction or control, or the intentional or accidental introduction of species, alien or new, to a particular part of the marine environment, which may cause significant and harmful changes thereto. • This article does not affect the application of this Convention regarding the prevention, reduction and control of pollution of the marine environment.

D-2: Ballast water performance standard  less than 10 viable organisms / tonne ≥ 50 μm; and  less than 10 viable organisms / ml ≤ 50 μm and ≥ 10 μm; and  indicator microbes ≤ following concentrations: - Vibrio cholera< 1 cfu /100 ml -Escherichia coli< 250 cfu /100 ml- Intestinal Enterococci< 100 cfu /100 ml
