The EU & Sport • Some Background: • In 1991 E C launched its first European Sport Forum. • Community rules often in conflict with sport rules • EAS calls for help Commissioner Viviane Reding and DG 10, but even with declaration of Amsterdam Treaty and Nice Treaty Commission didn’t the right power. • MLA WG succeeded to have FAI definition as the official definition, recognises by the JAA and the Commission • The project of the “Constitution for Europe” included in its article III-182 : “Union shall contribute to the European sporting issues, while taking account of the specific nature of sport, its structure based on voluntary activity and making its social and educational function …”. But France and Netherlands rejected the European Constitution. This was considered as a real check by the sport world

  3. The EU & Sport • The White Paper- Commissioner Jan Figel issued a strategy paper on sport. -Sport stakeholders and Member States were consulted during several conferences. This long consultation gave rise to THE WHITE PAPER -The last consultation of the Sport world happened in Brussels on 8-9 October last year.

The EU & Sport • Introducing Sport into the Revised Treaty • White Paper presented at the Informal Meeting of Sports Ministers in Lisbon on 25 October 2007. - With the help of White PaperSPORT is introduced in Revised Treaty -Lisbon Treaty signed by the EU leaders on 13 December 2007 • Target date for ratification of Treaty: 1 January 2009 – before EP elections

The EU & Sport • Political Process of White Paper White Paper = Commission proposal COM(2007)391 is in process to be submitted to the European Parliament, to the Regions Committee and to the Social and Economic Committee • Previsions : - 31 March 2008 EP Education and Culture Committee 1st reading ; - 07 May 2008 EP Plenary 1st reading

The EU & Sport • What is the main aim of the White Paper? • Commissioner Jan Figel announced on 8-9 October : “it is to mainstream and thus support sport into other policies of the EU and to set the conditions for improved governance in European Sport, by providing guidance for the application of EU rules”. • More information on White Paper:http://ec.europa.eu/sport/index_en.html

The EU & Sport • Could the Lisbon Treaty and the White Paper be beneficial for the Sport & Recreational aviation ? • I would expect yes, because: the specific nature of our sports, its structure based on voluntary activity will be taken into account and our sports will hopefully be supported into other EU policies.

  8. Insurance • E P & Council Regl 785/2004 • While in discussion at EP, EAS obtained various lightening of requirements for Sport and Recreational Aviation; • In Nov 2007, EAS responded to the Commission consultation in view of the revision of the Regulation

  11. Regulation 1592 modified • Wat is new for EMF ? - Annex II includes now 472,5 Kg when Microlight is equipped with parachute; - EASA will consult stakeholders to find out if Light aircraft up to MTOW of 600 Kg should not be placed in Annex II.

Regulation 1592 modified • For those sport aircraft that are not in Annex II, they will have to comply with: • Regulation 1702/2003 on Airworthiness (see Jan’s proposal : CS or Part 21) Publication March 2008 • Regulationl 2042/2003 on Maintenancestarting 28/9/08 . Consultation (NPA), CRD published waiting for EASA proposal to Commission. • Whenever ready Regulation on Licensing & Operations. Prevision 2009 Proposal MDM032
