  1. Guide to New York City Sidewalk Violations!

  2. Introduction • If you are the property owner, it is very important to know your responsibilities related to the sidewalk violation in NY. • While there are laws and courtrooms that have cracked down on frivolous lawsuits that are more on the complainant’s shoulders rather than the property owner, ignoring existing and necessary sidewalk repairs and violations can still cost you big time in NY.

  3. Who is responsible for sidewalks in NYC? • According to sections 19-152 and 16-123 of the New York City Administrative Code, under NYC law. The property owners are responsible for the sidewalks on their property. This means they are liable to keeping them in good repair and free of snow, ice, dirt, and other hazards. • Failure to comply will result in fines and infractions, but this is not the worst of it. • If you are not new to all this, you will be probably aware of responsibilities already. But keep in mind that you should have a sidewalk violation general contractor in mind to work with for maintenance and repairs to avoid any fines from the Department of Transportation.

  4. Sidewalk violations: • A sidewalk violation is an official notice issued by the Department of Transportation (DOT) stating that your sidewalk is defective. The role of DOT is to inspect the sidewalks throughout the city to ensure that everything is in place and safe based on specific criteria. They will also inspect the blocks where injuries were reported or the complaints were filed to the city. • Though it is important to know that there is no fine associated with a violation. But a copy of the notice is filed with the country clerk and all this remains on file until satisfactory repairs have been made and the information is updated to the clerk. But this violation can have serious impacts and can complicate refinancing procedure or if you were about to resell your property.

  5. Other important things that property owners in NY should know: • Regularly, the NYC Department of Transportation inspects the sidewalks and also takes into account the last time the place was being surveyed or inspected for the defects and if the repairs have been made, notifying property owners of any required repairs. • Some of the most common reasons for repairs that you should know are as follows: • Collapsed sidewalk • Improper slope • Patchwork • Holes • Large cracks • Trip hazards • Tree roots

  6. Hire a contractor: • The trick is to make sure that you take care of it, by checking time-to-time before it gets worse and pair up with an expert so that you can avoid financial liability for incidents and also avoid hefty fines. • Before tying up with a contractor, check whether they understand DOT specifications and if they have certification and license to do so.
