BUDGET ISSUES • General fund reduction of $1.5 million. • No funds for Quantity Verification • No industry support for State funding • DA one time cy pres funding for Price Verification • No funds for CTEP • Regulations adopted 12/30/2011 for funding • No funds for Device Enforcement • DMS Administrative Fee Regulations at office of Administrative Law for review – projected adoption date 02/10/2012 • Metrology Laboratory • General funds through at least 2012/2013 • Weighmaster Enforcement • Working with industry to legislatively increase license fees • Petroleum Enforcement • Working with industry to increase motor oil fee by regulations

DMS UPDATE • DMS Reorganization – • Laboratory Branch – Metrology and Petroleum Laboratories • Enforcement Branch – Weighmaster Enforcement, Petroleum Enforcement, Device Enforcement, CTEP, RSA, Price Verification • Staffing – • Retirements – Gerry Allen (Fresno), Joe Raspino (Sacto) • Transferred to other CDFA Divisions – Gary Castro, Charlie Nelson, Greg Mukai, Param Singh – Feed, Livestock Drugs, and Fertilizer • Transferred to other DMS Programs – Dennis Gorman, Dan Reiswig – Petroleum; John Roach – CTEP, Measuring Laboratory; Norm Ingram – CEC Hydrogen Project • Promotions – Kevin Batchelor – Branch Chief Enforcement Branch

LEGAL ADJUDICATIONS • Short measure plastic settlements: • HBL Imports Corp. - $53,860 • Orion Plastics Corp. - $52,012 • Republic Bag, Inc. - $266,000 • Super Plastic Sales, Inc. - $7,231 • Union Packaging, Inc. - $16,275 • Wardley Industrial, Inc. - $15,500 • Yuzhong Packaging, Inc. - $20,000 • Grant Laboratories – short measure ant bait - $249,000 • Chlorox, Inc. – slack fill - $199,654 • 99 Cent only Stores – false/misleading advertising - $347,372 • Fastenal – POS w/o customer displays, selling in less than true quantity, improper labels - $292,558

LEGAL ADJUDICATIONS • CVS Pharmacies, Inc. – overcharging customers - $2,020,756 • Tomra Pacific – using unsealed devices, indicator not visible to customers - $662,244 • Television cases combined to include: LG Electronics, USA; Panasonic Corp. of North America; Samsung Electronics America; Sharp Electronics – misrepresenting the size of TV screens - $1,250,000

FUTURE ISSUES • Replacement of key supervision/management staff and lost expertise and historical knowledge • Development of Specifications and Tolerances • Coin Counters – Coinstar Survey • Ice Vending Machines • Reverse Vending Machines for Recycling • Electric Vehicle Charging Stations – dispensers and advertising/labeling • Hydrogen Fueling Stations – dispensers and advertising/labeling
