  1. RELATED TO AGENDA ITEM 4 Proposed Modifications to Ordinance Nos. 1-3 April 3, 2014 Executive Committee

  2. Committee Review • June 11, 2013: Staff sought input from Marketing, Service Planning and Business Development Committee (MSPBD). MSPBD Committee directed staff to consider proposed revisions that would eliminate the consumption of alcohol on COASTER. • October 3, 2013: Staff sought input from the Executive Committee which supported bringing proposed revisions to the full Board. • Following public outreach and robust public response, NCTD notified public that it would delay consideration to allow staff time to further consider public feedback and to review other policy and safety/ security considerations. • February 5, 2014: Staff sought input from the MSPBD Committee which supported bringing proposed revisions to full Board. • Executive Committee to provide guidance to staff on timing to bring to full Board for consideration.

Current Ordinances • Ordinance No. 1 - Prohibits smoking on NCTD property and vehicles • Ordinance No. 2 - Allows open bottles and consumption of alcoholic beverages on COASTER trains until 9 p.m. • Ordinance No. 3 – Outlines prohibited conduct on NCTD property and vehicles and provides citation and arrest authority for violation of NCTD Ordinances

Proposed Revisions to Ordinance No. 1 In order to aid enforcement and protect all NCTD customers, staff recommends that Ordinance No. 1 be modified to: • limit the definition of NCTD Transit Facility to include only property owned and/or leased by NCTD; and • limit the enforcement area to “at and within” NCTD Transit Facility property as defined • expand to include electronic and vaporized cigarettes

Proposed Revisions to Ordinance No. 2 • NCTD’s most compelling concern remains the attendant liability and risk to passengers and crew associated with the safety concerns created by consumption of alcohol on board COASTER • Recommendation: rescind Ordinance No. 2 in its entirety making open containers and consumption of alcohol on COASTER impermissible at all times consistent with NCTD’s other modes

  6. Proposed Revisions to Ordinance No. 3 Proposed revisions would: • Clarify NCTD enforcement authority/area • Add electronic cigarettes and vaporizers to prohibited conduct list • Allow closed, spill-proof beverage containers on all NCTD modes • Prohibit open containers and the consumption of alcohol on all modes • Clarify that light meals/snacks are permissible only on COASTER (commuter rail amenities include trash receptacles, bathrooms, water fountains, etc.)

  7. Current Staff Activities • Civility Rules Campaign • Focus on key rules of riding • Posters on all modes • Handouts on COASTER • Increased enforcement presence • Focus on rider education • Social media component

  8. Next Steps • Provide guidance to staff on timing for bringing to full Board for consideration • Once timeline is confirmed, staff will develop public outreach and education program
