  2. ABOUT Celine Robichaud Fournier • Family law matters are complex. Various intertwined legal issues are often involved in one single case, combined with difficult emotional components. This difficult combination is what drives Celine's dedication and motivation. • I am passionate about family law and committed to my clients. I empower my clients with solutions. You can count on my experience, expertise, innovation, and talent. That is the truth… or veritas! https://celinerobichaudfournier.com/ +1-5063821050

  3. SERVICES: Common Law Relationships • Rights and obligations of common law spouses are the subject of much litigation, as in New Brunswick, the Marital Property Act does not apply to “common law couples” upon division of property and debts. • Whether or not your relationship is considered a “common law relationship” will depend on your situation. • Celine will guide you through the important issues. https://celinerobichaudfournier.com/ +1-5063821050

  4. SERVICES: Family Law, Business Assets If either you or your partner own a business, are co-owner, or own stocks in one, there are some legal issues that you should know about, for example: • Income determination for Child and Spousal Support; • Division of Assets between Spouses and Valuation of the business or of the shares; • Jointly-owned Corporations (the family business) and the tax implications upon separation. https://celinerobichaudfournier.com/ +1-5063821050

  5. SERVICES: Division of Property and Debts • Family assets include property owned by one or both spouses and are ordinarily used by them and their children while they are living together for shelter or transportation, or for household, educational, recreational or social purposes. • The most common types of marital property are the marital home or homes, household goods, money, personal investments, pension plans or retirement funds, automobiles and recreational vehicles. • Celine Robichaud Fournier can guide you through all the important family law issues around dividing property and debts. https://celinerobichaudfournier.com/ +1-5063821050

  6. SERVICES: Child and Spousal Support • The amount of child support payable is determined by looking at the Child Support Guidelines for the province in which the payor parent resides, or, if the payor parent resides outside of Canada, the province where the recipient parent resides. Child support is based on the number of children and the income of the payor parent and is determined by the type of “custody arrangement” in place. • Entitlement to spousal support is not automatic. Once entitlement has been established, the duration and amount of spousal support to be paid are complex legal issues with which I can assist. • Unlike child support, there are no legislated ‘tables’ providing for clear spousal support payment amounts. Spousal support is considered taxable income in the hands of the recipient and is tax deductible to the payor. There are many factors that guide the analysis of how much spousal support should be paid and for how long. https://celinerobichaudfournier.com/ +1-5063821050

  7. SERVICES: Custody and Access One of the most common questions that separated parents ask is “What will happen to our children?”. I can assist you in dealing with important issues such as: • Who will make important decisions for the children? • Where will the children live and how much time will be spent with each parent? • What happens if one parent has to move away from the jurisdiction? • Do grandparents have rights? • Can a Custody agreement be modified? • Can separated parents travel with their children? What are the procedures and concerns? • Do children have a voice or a choice? https://celinerobichaudfournier.com/ +1-5063821050

  8. SERVICES: Separation and Custody • You do not apply to the court for a separation. There is no such thing as being ‘legally separated’ in Canada. The expression “legally separated” indicates that former spouses have a signed Separation Agreement. • I can help you negotiate and draft a Separation Agreement. • To obtain a Divorce, an application must be filed with a court along with certain documents. • Usually, married couples obtain a “Separation Agreement” prior to filing for Divorce. • I can guide you through your chosen course of action. https://celinerobichaudfournier.com/ +1-5063821050
