  2. 7/11 Mumbai Bomb Blast – Status of Action – Relief – Rehab - Treatment • 1 year over – shattered 1077 families. • Struggle for relief & rehabilitation …continues • Red-tapism, Apathy…. goes on… • Commitments of Relief, Rehabilitation, Medicine yet to complete. • Government refused hearing aids / surgeries / artificial limbs / medical treatment.

  3. Action – Relief– Rehab–Treatment… • Ex-gratia compensation (immediate relief) yet to be completed. • State govt. paid to 884 while Railway 1058. • Railway Claim Tribunal only 174 Claims / Payment completed. • Compensation was taxable (33%) Exemption G.R. came in June 2007

Status of Railway Claim Tribunal • Special Bench announced in Aug’ 2006 • Special Bench formed in Dec’ 2006 • Only 5 Sitting till now • 515 Claims filed in all • 164 Death cases Disposed • 339 Injured claims filed, of which 10 Disposed • Others not able to file claims due to apathy, non-cooperation, harassments.

Compassionate Jobs in Railway • ‘Majak’ with family of Dead-victim • Railway offering jobs in ‘D’ Grade only • Jobs offered Helper, Hamal, Peon… • Post graduate, professionals, widows offered jobs as Helper - Peon • Irritating inhuman behaviour • Of 235 Eligible – Only 118 applied & 44 joined • Victims lost hand, leg were refused as they “lost 65% of limb instead of 70%” • Victims/families eligible are sufferer of red-tapism

Apathy of system • Apathy of system is evident from the incident • Hon’ble President sent donation of Rs.25 lacs from Rashtrapati Bhavan for the medical treatment of the hearing loss of the Blast victims. • The cheque was sent to Govt./BMC Hospital. • The same was returned to Rashtrapati Bhavan with observation, “There is no need of such help”.

State Govt. declared it Minor Injury & sanctioned Rs.5,000

  23. State Govt. Affidavit to NHRC…Response & Commitment • As per the mutual decision, medical bills are being reimbursed by the Western Railways • Collectors of Mumbai City, Suburban District & Thane have been advised to collect copies of FIR from the Police Department (ATS) and provide to the persons requiring it. • As was decided with the WR, Railways have made the reimbursement of medical bills. • State Govt. has already made the payment to 502 person receiving grievous injuries as on 10 Oct. 2006

Affidavit to NHRC…Response & Commitment • State Govt. has so far made payments to 132 persons receiving minor injuries as on 10 Oct. 2006 • Public Health Department directed all the hospitals, both Government & Private, not to collect payment from the patinets for medical treatment. • Govt. of Maharasthra is periodically monitoring the status of disbursement of payment to the private hospitals and expediting the matter. • Hearing aids can be made available to the patients when demanded

  34. Action Plan Suggested… • Amend guideline and provide artificial limbs, hearing aids, etc. • All medical expenses be reimbursed • Directives be issued to complete payment of ex-gratia immediately • Proper job of ‘C’ or ‘D’ Grade as per qualification and need of the person - amend directives

Action Plan Suggested… • Railway Claims Dept. should be asked to approach each and every affected family and get claim filed. • Number of victims differs from Department to Department, Ministry to Ministry and Government to Government. One final list of 1077 prepared by Police/Railway should be treated as the base list. • All the concerned Departments be asked to provide legally eligible help to minimum 1077 families. • A Coordination Committee under the Chairmanship of Additional General Manager, Western Railway, Rehabilitation Secretary, Police Commissioner & Petitioner • Publication of weekly Progress Report.
