The IDEA and LRE • Individuals with Disabilities Education Act • Regulates how public agencies provide educational and related services • School districts don’t have to follow the IDEA act unless receiving federal funding from it • “Least Restrictive Environment” • part of the IDEA • Students with disabilities should have the opportunity to be educated with non-disabled peers The IDEA LRE

  5. Court Case SACRAMENTO CITY SCHOOL DIST. v. RACHEL H., • 12 year old, Rachel Holland, with mental retardation • Law states that children must, to the highest extent possible, be taught with peers with out disabilities • The school decided that Rachel should spend half the day in the special recourse lab, and half in general education. • Parents fought that she was not being taught in an equal environment • School district lost funding under the IDEA and has to continue to provide with a beneficial learning environment to all students
