Shift decision making TO Level of discretion EU regulation National regulation • e.g. Third Gas Directive • Unbundling: 15 articles with strict requirements for unbundling and operational independence TSO • Independence NRA: each Member State shall designate a single national regulatory authority and shall guarantee its legal and functional independence, specified in detail on budget, staffing, reporting etc. • Unbundling: discrete choice between ownership unbundling, and two narrowly defined alternatives (ISO, ITO) • NRA: implementation of described measures to guarantee independence

IFIEC position on TEP We support: Unbundling Independent NRA ACER/ENTSO Binding rules for cross-border transport and trade Coordinated investment planning Information and transparency requirements Closed distribution systems …but implementation requires: Solutions which result in the widest possible choice among supply options, including long-term contracts Application of binding rules providing efficient allocation and maximising capacity use Coordinated investment planning and measures removing infrastructure bottlenecks Significant increases in transparency Clear regulatory framework for industrial grids avoiding unncessary administrative burden Transparent consultation process design, allowing effective stakeholder input We need an additional package to deliver: Market facilitation approach towards essential facilities such for UGS and LNG Perspective towards European system operator Measures to address structural market power problems Strategic framework linking the EU and global gas market

  12. Questions and issues What will be the rules of the consultations and who will set these? What are the priorities for Framework Guidelines and Codes and why? What is the sequence of developing Framework Guidelines and Codes? What will happen between now and the establishment of ACER? What will be the impact of the development of Framework Guidelines and Codes for industrial energy consumers?
