  1. ICPC Regulation 7Changes effective October 1, 2011 Presented by Erika Wainaina, LMSW Idaho ICPC Administrator

  2. ICPC Regulation 7 applies when the placement resource is a parent or close relativeAND: • 1) one child is 4 years old or younger and their siblings if being placed in same home, or • 2) one child being placed has substantial relationship with placement resource, or • 3) in care due to an unexpected dependency, or • 4) in an emergency placement

  3. ICPC Regulation 7 cannot be used: • If the child has been placed in the receiving state in violation of the ICPC • If the request is being made for Foster Care or Adoption • If the request packet is not sent within 5 business days after the court order is filed

  4. Court must enter a new Regulation 7 order of compliance • Specific language must be included on how the case meets Regulation 7 criteria • Affirms that the court has received a Regulation 7 statement from the case worker • Specifies the type of home study being requested

  5. Types of home study requests: • Provisional approval for placement pending a more comprehensive home assessment (Sets a time frame of 7 calendar days for initial decision) • A comprehensive home assessment (Sets a 30 day time frame) • Provisional approval for placement with a parent from whom the child was not removed and concurrence to relinquish jurisdiction upon final approval (7 day time frame with the understanding the sending state wishes to close the case after placement)

  6. Judicial recourse for non-compliance • If time frames are not met, notice should first go through the ICPC offices • If no action is taken, the courts in the sending state may make a formal complaint with the receiving state courts
