  1. The relationship between the National Veld and Forest Fire Act (NVFFA) and the Fire Brigade Services Act (FBSA)

The Fire Brigade Services Act • Allows for the establishment, co-ordination and standardisation of fire services throughout SA. • Local authorities are allowed to establish a fire brigade service for the following purposes: • Preventing the outbreak or spread of fire; • Fighting or extinguishing fire; • The protection of life or property against a fire or other threatening danger; • The rescue of life or property; • Subject to the provisions of the Health Act, an ambulance service as an integral part of the fire brigade service; and • The performance of any function connected with any of the above purposes. • The head of such a fire service is the Chief Fire Officer (CFO)

  3. How the Fire Brigade Services Act fits into the picture (1) • Enforcement • Where there is an FPA, the CFO will be the FPO if s/he is willing. The FPO enforces FPA rules. The FPO, CFO and any member of the Fire Service may enforce the NVFFA. Municipal fire services are part of an FPA and help to draw up its veldfire management strategy and rules. • Where there is no FPA, there will be no FPO and the CFO may enforce by-laws if applicable. The CFO and any member of the Fire Service may enforce the NVFFA. There will be no veldfire management strategy and FPA rules. By-laws passed under the FBSA may substitute for these.

How the Fire Brigade Services Act fits into the picture (2) • Fire readiness and firebreak standards • Where there is an FPA, standards set by the FPA for fire readiness and firebreaks will bind all members, Non-members may be bound by by-laws. • Where there is no FPA, by-laws can set standards for fire readiness and firebreaks, which bind all persons. The CFO may check for compliance.

  5. How the Fire Brigade Services Act fits into the picture (3) • When a veldfire breaks out • Where there is an FPA, the NVFFA applies to fighting the fire. The owner is the first line of defence. The FPO takes charge if the fire threatens life, property or the environment. • Where there is no FPA, the NVFFA also applies to fighting the fire. The owner is the first line of defence. There is no FPO to take charge. The CFO or other role players may play this role.

  6. How the Fire Brigade Services Act fits into the picture (4) • When an urban fire breaks out • Where there is an FPA, the FBSA applies to fighting the fire (e.g. in a town that is part of the FPA's area). • Where there is no FPA, the FBSA also applies to fighting the fire.
