  14. Penalties • If convicted, even if a juvenile, the guilty person must register as a sex offender. This could remain on the person’s record for life, or a limited time, held to the discretion of the judge. • Harmful – Misdemeanor of the 1st degree • Obscene – Felony of the 5th degree • Under 13 years of age – Felony of the 4th degree (regardless of anything…no matter what) Exceptions: exhibit/medical situations only

  15. Con’t A juvenile can’t determine if it’s (picture/video/live performance/pornography) harmful to them or not…this is determined by the law enforcement involved.
