  1. One the things we found most troubling about the City’s Draft Environmental Impact Report (DEIR) was that there was no information included about your pipeline, and ways to protect it from construction damage and loading forces. We were equally concerned that in the Final Environmental Impact Report (FEIR) there were no comments from Travis Air Force Base pointing out this deficiency in the DEIR, and providing information necessary to protect your pipeline and avoid illegal encroachment on your right-of-way. In fact in the FEIS the City provides email correspondence with Travis Air Force Base indicating that the base has “no comments.”

This can be easily remedied, and the public’s fears put to rest, if you direct your staff to provide Suisun City staff with clear information about your pipeline and a plan to ensure that it is protected from possible significant impacts from this proposed development along Petersen Road. Section 51014.6 of the California Government Code Effective January 1, 1987, no person, other than the pipeline operator, shall do any of the following with respect to any pipeline easement: (1) Build, erect, or create a structure or improvement within the pipeline easement or permit the building, erection, or creation thereof. (2) Build, erect, or create a structure, fence, wall, or obstruction adjacent to any pipeline easement which would prevent complete and unimpaired surface access to the easement, or permit the building, erection, or creation thereof. (b) No shrubbery or shielding shall be installed on the pipeline easement which would impair aerial observation of the pipeline easement.

You stated in your letter to us that a “thorough review of the draft and final EIRs for the Walmart Project has been accomplished which screened for potential conflicts with our mission and more specifically to ensure our continued ability to safely access, operate and maintain our pipeline.” While we hope that this is true there still has been no evidence provided that would allow citizens or Suisun City officials to believe this. On the other hand there is plenty of evidence that appears to show that Travis Air Force Base has allowed its right-of-way to be compromised, and access to its pipeline seriously interfered with.   7. we hope you will attend the upcoming hearings on this project, and provide Suisun City, and its affected citizens, with enough information to ensure that this project can go forward in a way that is safe for the public and your pipeline. At a minimum this would include a clear map of your pipeline and easement location, and clear instructions for the City and developer to follow in gaining your approval to cross your easement and damage prevention information for working near the pipeline. We have attached a sample of such instructions from a similar sized liquid pipeline we recently ran into while reviewing a proposed development in a very rural area of Montana.

  8. Since this is a trust, When was the last board of director's meeting? Has Pipeline Safety Trust filed their 2006 - 2007 IRS Form 990s? Does your staff or board have structural, civil, subsurface, mining or other engineering degrees? The name "Pipeline Safety Trust" makes you sound like you have some knowledge or training on the subject. It seems deceptive if you really do not have any advanced education or experience.
