Cases referred to OAG • 523 cases have been referred to OAG from the Commitment Review Committee (“CRC”) to date • As of June 18, 2009: • OAG has filed petitions in 320 cases (65% of cases referred) • OAG has not filed petitions in 175 cases (35% of cases referred) • 28 cases still under review

  4. Status of cases filed by OAG • Of the 320 cases filed by the OAG: • As of June 18, 2009, 209 cases have been completed or resolved in the courts • 111 pending in the courts: • 12 probable cause (PC) hearings pending • 80 trials pending • 19 disposition hearings (where Respondent was declared an SVP and a hearing is held to determine commitment v. conditional release)

  5. Completed SVP cases • Of the 209 total cases completed in court: • 176 Respondents found to be SVPs • 27 Respondents released as not meeting SVP criteria (including 5 at PC hearing) • 6 cases withdrawn/dismissed by OAG prior to trial • Of 203 cases decided on the merits: • 40 were resolved by consent orders

  6. Respondents found to be SVPs • A total of 195 Respondents have been found to be SVPs by the courts: • 151 have been ordered to be civilly committed • 25 are on conditional release • 19 are still pending disposition

  7. Civilly Committed SVPs • As of June 18, 2009, 151 SVPs were ordered to be civilly committed: • Approximately 23 were committed by agreement of the respondent (a consent order was entered) • Includes 6 SVPs who were initially placed on conditional release, but who later had their conditional release revoked

  8. Conditionally Released SVPs • 25 SVPs on conditional release • At least 14 SVPs were placed on conditional released by agreement between OAG and Respondent (consent orders entered) • 2 SVPs currently have revocation hearings pending • 1 individual is now deceased

  9. Annual Reviews for committed SVPs • Annual review experience • Not uncommon for SVPs to waive their annual review hearing • 2 SVPs have been released onto conditional release at their annual review hearings • Courts have ordered conditional release plans to be prepared for consideration in at least 5 more annual review hearings
