The Definition of "Expungement" Expungement by legal definition is a court-ordered process in which the legal record of an arrest or a criminal conviction is "sealed," or erased in the eyes of the law. This process may also be referred to as "setting aside” a criminal conviction. When a criminal conviction is set aside, the public records may also be removed. By giving you the chance to clear criminal history, expungement is the best way to bury your past because it amounts to having your criminal records sealed. In order to have this done, you must voluntarily undergo the expungement process. It allows you to move past your convictions because with an expungement, you don't have to tell anyone that you were arrested or convicted of a crime ever again. This means that when you apply for a job, you don't have to answer the question on the application about whether or not you have been arrested. You are entitled to do the same when you fill out an application to rent an apartment. The Limitations of Expungement Even though your criminal records will be sealed, it does not mean that no one will ever see the arrests or convictions on your record. A limited number of people will be able to see these past events. Law enforcement agencies and criminal courts will have access to this information. Therefore, if you are arrested in the future, you cannot count on a clear criminal history after your expungement. Expungement means that your record is "under seal," but a record under seal will be proof to law enforcement that you had a prior conviction.
