  2. Overview During negotiations, which spanned a time period of almost two years, the Team amended 31 of 37 Articles and added additional Articles. At the same time, resisting concession that the Judicial Branch attempted to gain during the process.

  3. Overview Almost all Articles had Substantive Changes 3 new Articles were added Many Articles had Ministerial/Scrivener Changes 5 Articles kept the current contract language

  8. Appeal Procedure • Final decision in Supreme Court requested by management • No – it will remain with the Appeals Board • Wanted to overturn decision that Appeals Board awards/grievance procedure – no precedential effect

  9. Administrative Leave Scrivener changes Addition of part time employees on a prorated basis of budgeted hours If excessive, review proration Example: Part time employees scheduled for 20 hours entitled to 3 days off per year  20/37.5=.5x3=1.5

  10. Annual Leave Inclusion of part time employees on a prorated basis. If exceeds than request for review can be made to Manager of Operations Same calculation provisions for part time employees

  11. Assignment/Reassignment Any court monitor/Assistant reassigned to a new division will have 21 days notice Inclusion of Circuit Courts

  12. Association Representation Confidential space Employees entitled to 24 hour notice of disciplinary meeting, except in extraordinary circumstances.

  14. Basic Work Week Full Time = 37 ½ hours -No full time employee shall be converted to part time without consent” Inclusion of part time employees – as posted with 90 days notice Elimination of reference to rules

  15. Basic Work Week (cont.) Break Periods-occur halfway through start/end of shift and meal time. 15 minutes for each work period of more than 3 hours. Meal Periods-employees working 5+ hours shall be entitled to no less than ½ hour no more than 1 hour meal break

Cost of Living • Fringe Benefits: Section 19.8.1 of State Contact • $20 per pay period for employees with salaries less than $33,000.00 • $40 per pay period for employees with salaries more than $33,000.00 up to $45,000.00 • $60 per pay period for employees with salaries more than $45,000.00 • Part time employees with 30+ hours per week shall be prorated • If legislation applies to judicial branch, the parties will collectively figure it out

  17. Cost of Living (cont.) • Salaries: No change (only classified employees to receive steps) • In future – if legislation applies, the parties will collectively figure it out • Reclassifications: • 120 days required for individual position • 150 days require for several positions

Disciplinary or Adverse Action • Cannot demote for disciplinary reasons • Added 2 items to actions that may result in disciplinary action: “(18)Knowingly provide case or court file relation information to persons or entities not entitled to that information or to persons or entities outside of standard or customary procedures; or (19) notwithstanding any of the above, violating employee standards of conduct, which recognizes that: Every position in the Judicial Branch is a public trust. Employees must conduct themselves in a manner which will uphold the dignity and integrity of the Judicial Branch. Employees must observe standards of fidelity and diligence appropriate to their position the Judicial Branch.

  23. Grievance Procedure Scrivener Clarified Judicial Branch on beginning Step II Grievance Maintained provision by outside arbitrator and grievance procedure after appeal procedure for contract interpretation

  25. Layoffs Scrivener Less then 7 years based on 8 lists Affected employee(s) shall receive at least 21 days notice All layoffs shall be “equally apportioned” Beyond 7 years – 2 seniority lists: full time & part time

Post vacant bargaining unit positions on the 1st and 15th of each month for after external recruitment Laid off full time employees on recall list have right of first refusal for converted positions over laid off part time employees Timely period for interest in a posted position is 10 with days of posting Must report to work within 15 days after employee is recalled to work

  27. Longevity Computation & Compensation Proration for part time employees not participating in the NHRS Calculation same as Annual Leave and Administrative Leave

  28. Other Leave • FMLA • Management required to notify employee within 5 business days of changes

  29. Performance Evaluation If evaluation is less than satisfactory, it will include a list of individuals whose input was considered in the development of the evaluation

  31. Reduction in Hours Removed furloughs Left personal days

  32. Resignation Scrivener Retiring employee shall be paid within 60 days as opposed to 90 days

  33. Sick Leave Scrivener Inclusion of part time employees 6 days of entitlement to bereavement leave or dependent illness leave with no loss of bonus leave

  34. Training Court monitor/assistants keep current contract language All other employees have a minimum of 3 days training

  35. Travel & Mileage Scrivener Administrative authority shall submit within 5 days of receipt, employee shall be paid within 21 days
