CA Water Code Section 9612 Review and Adoption Process – Legal Requirements: • No later than January 1, 2012, the department shall prepare the Central Valley Flood Protection Plan in accordance with this part, and shall transmit the plan to the board, which shall adopt the plan no later than July 1, 2012. • The board shall hold at least two hearings to receive comments on the proposed plan. At least one hearing shall be held in the Sacramento Valley and at least one hearing shall be held in the San Joaquin Valley. The board shall also accept comments in writing with regard to the proposed plan. • The board may make changes to the proposed plan to resolve issues raised in the hearings or to respond to comments received by the board. The board shall publish its proposed changes to the proposed plan at least two weeks before adopting the plan. • The plan shall be updated in subsequent years ending in 2 and 7.

  3. Board Plan Review Team • The Board’s Plan Review Team will handle scheduling, public comment processing, and technical review in coordination with DWR.

  4. Public Comment Receipt Process Board staff is currently receiving comments on the Plan and supporting documents: • The Team requests that comments be submitted using the downloadable Excel spreadsheet linked to the CVFPP tab on the Board’s web page at http://cvfpb.ca.gov/CVFPP/index.cfm.  A special Email address (cvfppcom@water.ca.gov) has been set up so that the comments (including any attachments) will be delivered to appropriate recipients. • The public may attach additional supporting documents to their Email as well. Commentor, Commentor Agency, Contact Email, Document, Chapter/Section, Page No., Comment, Proposed Modification

CVFPP Board Adoption Roll-out Board has completed a timeline of events that must take place (as outlined) in order for the Board to meet its statutory obligations for Plan adoption: January February March Marysville – January 26 Sacramento – February 24 Sacramento – March 23 Regular Board Mtg. DWR presents Draft Plan (January 27) Board invites stakeholders to suggest focus points for April public outreach hearings DWR presents PEIR Plan Actions Board accepts Plan and outlines review and public commenting processes Coordination and Review of Documents and Comment Processing Board Staff & DWR Coordination Oversight of review and adoption logistics Plan Outreach Committee

Sacramento – May 25 Sacramento – June 22 Plan Actions Public hearings (Sacramento, Stockton/Modesto, Marysville/Yuba City) Early May publically noticed workshops to discuss comment responses and proposed Plan changes Board adopts revised Plan Board notifies Legislature and Resources Secretary of Plan adoption Agenda based on focus points from stakeholders at February meeting, CEQA, and staff technical findings Adopt proposed Plan changes and post changes for 2 week minimum Board staff technical findings Board staff oversees Plan changes Staff presents revised Plan to the Board for adoption Board Staff & DWR Coordination Present topics for May workshops Ensure proper posting of Plan changes Prepares and deliver final documents Plan Outreach Committee

  7. Key Timing for the Public Process • DWR delivered the Public Draft of the Plan on December 30, 2011. • February 24 Board meeting: Solicit focus points for April Public Outreach • March 23Board meeting: Draft Programmatic Environmental Impact Report (PEIR) anticipated from DWR • April Public Outreach Hearings (2-3): Technical Review findings, CEQA, and focus point discussions • Early May Public Workshops (1-2): Discuss comment responses and proposed Plan changes • May 25 Board meeting: Adopt proposed Plan changes and post on Board’s website (2 week minimum) • June 22 Board meeting: Board to adopt the Plan
